63. Hind ke Naaeb Sadar e Jamhuriya. —
The Vice-President of India.—

Hind ke ek Naaeb Sadar e Jamhuriya honge.
There shall be a Vice-President of India.

64. Naaeb Sadar e Jamhuriya apne ohde ki bina par Shura e Riyaasaat ke Amiir honge.—
The Vice-President to be ex officio Chairman of the Council of States.—

Naaeb Sadar e Jamhuriya apne ohde ki bina par Shura e Riyaasat ke Amiir honge aur digar kisi aur munaafe ke ohde par faaez nahi honge:
The Vice-President shall be ex officio Chairman of the Council of the States and shall not hold any other office of profit:

Shart ye hae ke kisi bhi waqt jab Naaeb Sadar e Jamhuriya mazmoon 65 ke tehat Sadar e Jamhuriya ke haesiyat se Sadar e Jamhuriya ke a’amaal ki takmiil karenge tou, oosi waqt wo Shura e Riyaasaat ke Amiir ke faraaez anjaam nahi denge aur mazmoon 97 ke tehat Shura e Riyaasaat ke Amiir ki ujrat ya tankhwaah haasil karne ke haqdaar nahi honge.
Provided that during any period when the Vice-President acts as President or discharges the functions of the President under article 65, he shall not perform the duties of the office of Chairman of the Council of States and shall not be entitled to any salary or allowance payable to the Chairman of the Council of States under article 97.

65. Sadar e Jamjuriya ki ghaer maujudgi me ya onke ohde ka maqaam kisi aarzi bina par khaali hua ho tou Naaeb Sadar e Jamhuriya khud Sadar e Jamhuriya ki haesiyat se unke a’amaal ki taqmiil karenge.—
The Vice-President to act as President or to discharge his functions during casual vacancies in the office, or during the absence, of President.—

65(1). Sadar e Jamhuriya ke ohde ka maqaam maut ki wajaah se, istefe ya barkhaastgi ya kisi digaar wajaah se khaali ho jaaye tou, oos khaali maqaam ko bharne ke liye is Baab ke usul ke mutaabiq jab tak ke naye Sadar e Jamhuriya muntakhib ho kar apne ohde par faaez nahi kar diye jaate oos taarikh tak Naaeb Sadar e Jamhuriya khud Sadar e Jamhuriya ki haesiyat se maujud rahenge.
In the event of the occurrence of any vacancy in the office of the President by reason of his death, resignation or removal, or otherwise, the Vice-President shall act as President until the date on which a new President elected in accordance with the provisions of this Chapter to fill such vacancy enters upon his office.

65(2). Jab Sadar e Jamhuriya ghaer haaziri, bimaari ya digar kisi wajaah ke tehat apne a’amaal ki takmiil nahi kar sakte hou tab Naaeb Sadar e Jamhuriya oonke a’amaal ki takmiil oos taarikh tak karenge jab tak ke khud Sadar e Jamhuriya apne a’amaal ki takmiil dobaara shuru na kar de.
When the President is unable to discharge his functions owing to absence, illness or any other cause, the Vice-President shall discharge his functions until the date on which the President resumes his duties.

65(3). Naaeb Sadar e Jamhuriya oos muddat ke dauraan jab ke wo Sadar e Jamhuriya ki haesiyat se maujud hou ya unke a’amaal ki takmiil kar rahe hou, oos dauraan wo Sadar e Jamhuriya ke ikhteyaarat aur istesna’at ke haqdaar honge aur Qaumi Majlis ke zariya qaanuunan mutayyin kiye gaye munaafe, tankhwaah aur imtiyaazaat ke haqdaar honge aur, jab tab ke is mutalliq usul tayyar nahi kar diya jaata, aese munaafe, tankhwaah aur imtiyaazaat wohi honge jo Dusri Fehrist me darj hae.
The Vice-President shall, during, and in respect of, the period while he is so acting as, or discharging the functions of, President, have all the powers and immunities of the President and be entitled to such emoluments, allowances and privileges as may be determined by Parliament by law and, until provision in that behalf is so made, such emoluments, allowances and privileges as are specified in the Second Schedule.

66. Naaeb Sadar e Jamhuriya ka intekhaab. —
Election of Vice-President.—

66(1). Naaeb Sadar e Jamhuriya ka intekhaab ek intekhaabi ijma ke araakeen karenge jisme shaamil honge Qaumi Majlis ke dono Aewaan ke araakeen, intekhaab waahid muntaqli raae ke zariye tanaassubi numaaindagi ke nizaam ke mutaabiq hoga aur aese intekhaab ki raaye shumaari khufiya tarz par hogi.
The Vice-President shall be elected by the members of an electoral college consisting of the members of both Houses of Parliament in accordance with the system of proportional representation by means of the single transferable vote and the voting at such election shall be by secret ballot.

66(2). Naaeb Sadar e Jamhuriya Qaumi Majlis ke kisi bhi Aewaan key a kisi bhi Riyaasat ki Qaanuun-Saaz Majlis ke rukn nahi ho sakte, , aur agar Qaumi Majlis ke dono me se kisi bhi Aewaan ke kisi rukn ko ya kisi bhi Riyaasat ki Qaanuun-Saaz Majlis ke kisi bhi Aewaan ke kisi rukn ko Naaeb Sadar e Jamhuriya muntakhib kiya jaata hae tou, ye maana jaayega ke onhone oos Aewaan jiske wo rukn the waaha se apni rukniyat ko oos taarikh ko tarq kar diya jis din wo Naaeb Sadar e Jamhuriya ke ohde par faaez honge.
The Vice-President shall not be a member of either House of Parliament or of a House of the Legislature of any State, and if a member of either House of Parliament or of a House of the Legislature of any State be elected Vice-President, he shall be deemed to have vacated his seat in that House on the date on which he enters upon his office as Vice-President.

66(3). Koi bhi shaks Naaeb Sadar e Jamhuriya ke intekhaab ke liye aehl tab’hi maana jaay ga jab—
No person shall be eligible for election as Vice-President unless he—

66(3a). wo Hind ka shehri ho;
is a citizen of India;

66(3b). oosne paetiis saal ki umr poori kar li ho, aur 
has completed the age of thirty-five years; and

66(3c). wo Shura e Riyaasaat ke rukn ke intekhaab ke liye aehl ho.
is qualified for election as a member of the Council of States.

66(4) Agar koi bhi jo Hind ki Sarkaar ya kisi bhi Riyaasat ki Sarkaar ya aesi kisi bhi Sarkaar ke ikhteyaar ke taabe kisi bhi ilaaqaayi mehkame ke tehat munaafe ke ohde par faaez ho tou wo shaks Naaeb Sadar e Jamhuriya ke intekhaab ke liye naa-aehl maana jaayega.
A person shall not be eligible for election as Vice-President if he holds any office of profit under the Government of India or the Government of any State or under any local or other authority subject to the control of any of the said Governments.

Wazaahat.—Is mazmoon ke maqaasid ke liye, kisi shaks ko sirf is wajaah ke tehat munaafe ke ohde par faaez nahi maana jaayega ke ko Ittehaad ke Sadar e Jamhuriya ya Naaeb Sadar e Jamhuriya hae ya kisi Riyaasat ke Naazim e Riyaasat hae ya fir Markaz ya kisi Riyaasat me se kahi ek me wazir hae.
Explanation.— For the purposes of this article, a person shall not be deemed to hold any office of profit by reason only that he is the President or Vice-President of the Union or the Governor of any State or is a Minister either for the Union or for any State.

67. Naaeb Sadar e Jamhuriya ke ohde ki muddat. —
Term of office of Vice-President.—

Naaeb Sadar e Jamhuriya jis taarikh se apne ohde par faaez honge us taarikh se lekar paanch saal ki muddat tak apne ohde par faaez rahenge: Lekin— 
The Vice-President shall hold office for a term of five years from the date on which he enters upon his office: Provided that—

67(a). Naaeb Sadar e Jamhuriya chaahe tou, apne dast e khat ke tehat Sadar e Jamhuriya ko di gayi apni tehrir ke zariye apne ohde se ist’efa de sakenge;
a Vice-President may, by writing under his hand addressed to the President, resign his office;

67(b). Naaeb Sadar e Jamhuriya ko onke ohde Shura e Riyaasat apne hazir araakeen ki aksariyat ke zariye ek qaraardaad manzur karke barkhaast kar sakta hae; lekin is nukut ke maqsad ke liye aesi koi bhi qaraardaad tab tak pesh nahi ki jaa sakti jab tak ke ooske qable ek ittela jisme qaraardaad pesh karne ka iraada waazae kiya gaya ho aur oos ittela ko kam az kam chaudaah din ki muddat ki shart ke saath bheja nahi jaata. 
a Vice-President may be removed from his office by a resolution of the Council of States passed by a majority of all the then members of the Council and agreed to by the House of the People; but no resolution for the purpose of this clause shall be moved unless at least fourteen days' notice has been given of the intention to move the resolution;

67(c). Naaeb Sadar e Jamhuriya, ape ohde ki muddat ke khatm ho jaane ke baawajood, apne ohde par faaez rahenge jab tak ke unke jaanasheen ohde par khud faaez nahi ho jaate.
a Vice-President shall, notwithstanding the expiration of his term, continue to hold office until his successor enters upon his office.

68. Naaeb Sadar e Jamhuriya ke ohde ke khaali maqaam ko bharne ke liye intekhaab karaane ka waqt aur jis shaks ko oos khaali maqaam ko bharne ke liye muntakhib kiya jaaye tou onke ohde ki muddat. —
68. Time of holding election to fill vacancy in the office of VicePresident and the term of office of person elected to fill casual vacancy.—

68(1). Naaeb Sadar e Jamhuriya ke ohde ki muddat khatm hone se qabl hi oos khaali hone waale maqaam ko bharne ke liye intekhaab kara liye jaaye.
An election to fill a vacancy caused by the expiration of the term of office of Vice-President shall be completed before the expiration of the term.

68(2). Sadar e Jamhuriya ke ohde ka maqaam maut, istefe ya barkhaastgi, ya kisi digar wajaah se khaali hua ho tou maqaam khaali hone ke baad jald az jald khaali maqaam ko bharne ke liye intekhaab karaaye jaaye, aur jis shaks ko khaali maqaam bharne ke liye muntakhib kiya gaya hou, tou mazmoon 67 ke usul ke mutaabiq, oonka ye haq hoga ke jis taarikh se wo ohde par faaez huwe hou tou oos taarikh se mukammil paanch saal ki muddat tak oos ohde par faaez rahe.
An election to fill a vacancy in the office of Vice-President occurring by reason of his death, resignation or removal, or otherwise shall be held as soon as possible after the occurrence of the vacancy, and the person elected to fill the vacancy shall, subject to the provisions of article 67, be entitled to hold office for the full term of five years from the date on which he enters upon his office.

69. Naaeb Sadar e Jamhuriya ke Ohde ki Qubuliyat ki halaf.—
Oath or affirmation by the Vice-President.—

Har Naaeb Sadar e Jamhuriya ko, Sadar e Jamhuriya ki maujudgi me, ya unke is mutalliq muqarrar karda kisi shaks ki maujudgi me apne ohde par faaez hone se qabl, halaf lena ya aehad karna hoga, is tariqe se—
Every VicePresident shall, before entering upon his office, make and subscribe before the President, or some person appointed in that behalf by him, an oath or affirmation in the following form, that is to say—

“Mae, A.B., ‘Khuda ki Qasam leta hu/ pukhta aehed leta hu’ ke mae Aain e Hind par sachcha aetemaad rakhunga aur osse wafaadaar rahunga jaesa ke qaanuunan mutayyin kiya gaya hae aur mae imaandaari ke saath apne farz ki takmiil karunga jis par mae faaez hone ja raha hu.”.
"I, A.B., do swear in the name of God/solemnly affirm that I will bear true faith and allegiance to the Constitution of India as by law established and that I will faithfully discharge the duty upon which I am about to enter.".

70. Ba’az Naagahaani haalat ke dauraan Sadar e Jamhuriya ke a’amaal ki takmiil.—
Discharge of President's functions in other contingencies.—

Is baab me tazkira nahi kiye gaye kisi bhi naagahaani haalat ke dauraan Sadar e Jamhuriya ke a’amaal ki takmiil ke liye Qaumi Majlis aese usul qaayam kar sakti hae jaesa ke wo munaasib samjhe.
Parliament may make such provisions as it thinks fit for the discharge of the functions of the President in any contingency not provided for in this Chapter.

71. Sadar e Jamhuriya ya Naaeb Sadar e Jamhuriya ke itekhaab ke mutalliq, ya osse waabasta ma’amlaat. —
Matters relating to, or connected with, the election of a President or Vice-President.—

71(1). Tamaam shu’baat ya tana’azaat jo Sadar e Jamhuriya ya Naaeb Sadare e Jamhuriya ke intekaab me uthhe ya osse wabasta hou tou Adaalat e Uzma oonki taftiish karegi aur faesla karegi, jiska faesla hatmi hoga.
All doubts and disputes arising out of or in connection with the election of a President or Vice-President shall be inquired into and decided by the Supreme Court whose decision shall be final.

71(2). Agar Adaalat e Uzma, Sadar e Jamhuriya ya Naaeb Sadar e Jamhuriya ke ohde ke liye huwe kisi shaks ke intekhaab ko radd aelaan kar deti hae tou, Sadar e Jamhuriya ya Naaeb Sadar e Jamhuriya, jaesa bhi ma’amla hou, onke ohde ke ikhteyaaraat aur a’amaal ki takmiil ke dauraan onke kiye gaye kisi a’amaal ko Adaalat e Uzma ke faesle ki bina par radd nahi maana jaayega, jab tak ke wo a’amal oos taarikh ya osse pehle ki taarikh ko kiye gaye hou jis taarikh ko Adaalat e Uzma ka faesla sunaaya gaya hou.
If the election of a person as President or Vice-President is declared void by the Supreme Court, acts done by him in the exercise and performance of the powers and duties of the office of President or Vice-President, as the case may be, on or before the date of the decision of the Supreme Court shall not be invalidated by reason of that declaration.

71(3). Is Aain ke usul ke tehat rehte huwe, Qaumi Majlis, Sadar e Jamhuriya ya Naaeb Sadar e Jamhuriya ke intekhaab ke mutalliq ya osse waabasta kisi bhi ma’amle ko qaanuunan munazzim kar sakti hae.
Subject to the provisions of this Constitution, Parliament may by law regulate any matter relating to or connected with the election of a President or Vice-President.

71(4). Sadar e Jamhuriya ya Naaeb Safar e Jamhuriya ke intekhaab par kisi qism ka sawaaliya nishaan is bina par nahi uthhaaya jaa sakta ke jis intekhaabi ijma ke zariye unhe muntakhib kiya gaya hou, oos intekhaabi ijma ke araakeen me ghaer haziri ki waja se koi maqaam khaali tha chaahe wo kisi bhi wajuhaat ki bina par khaali raha ho.
The election of a person as President or Vice-President shall not be called in question on the ground of the existence of any vacancy for whatever reason among the members of the electoral college electing him.

72. Sadar e Jamhuriya ka me ma’afi, waghaera dene ka ikhteyaar, aur baaz muqaddamaat ke faeslou ko ma’atal karne ka, radd karne ka ya onki saza ko kam karne ka haq.—
Power of President to grant pardons, etc., and to suspend, remit or commute sentences in certain cases.—

72(1). Sadar e Jamhuriya ko darj e zeel ma’amlaat me saza me ma’afi dene ka, osko ma’atal karne ka, osme mohlat dene ya osko kam karne ka ikhteyaar hae ya darj e zeel ma’amlaat ke kisi bhi jurm me mujrim thhehraaye gaye kisi shaks ke oopar sunaaye gaye faesle ko ma’atal karne ka, osko radd karne ka ya oski saza ko kam karne ka ikhteyaar hae—
The President shall have the power to grant pardons, reprieves, respites or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence—

72(1a). oon tamaam ma’amlaat me jinka faesla ya saza kisi Fauji-Adaalat ne sunaaya ho;

in all cases where the punishment or sentence is by a Court Martial;

72(1b). oon tamaam ma’amlaat me jinki saza ya faesla kisi aese ma’amle ke mutalliq kisi qaanuun ke mukhaalif jurm me hae jo Markaz ke amaliyaati ikhteyaar ke tehat aata hae;
in all cases where the punishment or sentence is for an offence against any law relating to a matter to which the executive power of the Union extends;

72(1c). oon tamaam ma’amlaat me jinka faesla saza e maut hae.
in all cases where the sentence is a sentence of death.

72(2). Ittehaad ki Musalla Afwaaj ke kisi bhi afsar ko qaanuun ata kiye gaye kisi Fauji-Adaalat ke faesle ko ma’atal karne ke, radd karne ke ya oski saza ko kam karne ke ikhteyaar par nukut (1) ke zere-nukut (a) ka koi bhi pehlu koi asar nahi karta.
Nothing in sub-clause (a) of clause (1) shall affect the power conferred by law on any officer of the Armed Forces of the Union to suspend, remit or commute a sentence passed by a Court Martial.

72(3). Kisi maujuda qaanuun ke tehat Naazim e Riyaasat ka saza e maut ke faesle ko ma’atal karne ke, radd karne ke ya oski saza ko kam karne ke ikhteyaar par nukut (1) ke zere-nukut (c) ka koi bhi pehlu koi asar nahi karta.
Nothing in sub-clause (c) of clause (1) shall affect the power to suspend, remit or commute a sentence of death exercisable by the Governor of a State under any law for the time being in force.

73. Markaz ke amaliyaati ikhteyaar ki had.—
Extent of executive power of the Union.—

73(1). Is Aain ke usul ke tehat, Markaz ke amaliyaati ikhteyaar ki had ye hogi—
Subject to the provisions of this Constitution, the executive power of the Union shall extend—

73(1a). oon tamaam ma’amlaat me jinme Qaumi Majlis ko qaanuun-saazi ke ikhteyaar hae; aur
to the matters with respect to which Parliament has power to make laws; and

73(1b). kisi mu’ahide ya qaraardaad ki bina par Hind ki Sarkaar jin haquq ki, ikhteyaar ki ya hudud me takmiil karne ka haq rakhti hae:
to the exercise of such rights, authority and jurisdiction as are exercisable by the Government of India by virtue of any treaty or agreement:

Shart ye hae ke zere-nukut (a) me jis amaliyaati ikhteyaar ka zikr kiya gaya hae wo kisi bhi Riyaasat ke oon ma’amlaat par laagu nahi hoga jinme Riyaasat ki qaanuun-saaz Majlis ko bhi qaanuun-saazi ke ikhteyaar hae, siwaaye tab jab is Aain me zaahire taur par aesa intezaam hou ya Qaumi Majlis ke banaaye gaye kisi qaanuun me zaahire taur par aesa intezaam.
Provided that the executive power referred to in sub-clause (a) shall not, save as expressly provided in this Constitution or in any law made by Parliament, extend in any State to matters with respect to which the Legislature of the State has also power to make laws.

73(2). Jab tak ke Qaumi Majlis iske mutalliq itezaam nahi karti, tab tak Riyaasat ya Riyaasat ka koi afsar ya mehkama, is mazmoon ke kisi bhi pehlu ke baawajood, aese ma’amlaat me amaliyaati ikhteyaar ya a’amal ki takmiil karte rahenge jaese ke is Aain ki nafaazat se fauran qabl tak Riyasat ya Riyaasat ka koi afsar ya mehkama kar sakta tha, wo ma’amlaat Qaumi Majlis ke Riyaasat ke mutalliq qaanuun-saazi ke ikhteyaar ke honge.
Until otherwise provided by Parliament, a State and any officer or authority of a State may, notwithstanding anything in this article, continue to exercise in matters with respect to which Parliament has power to make laws for that State such executive power or functions as the State or officer or authority thereof could exercise immediately before the commencement of this Constitution.
