The Union And Its Territory


1. Ittehaad ka naam aur iski sarzamiin.
 
Name and territory of the Union.—

1(1). Hind, jo ke Bhaarat hae, wo Riyaasaat ka Ittehaad hoga.
India, that is Bharat, shall be a Union of States.

1(2). Uski Riyaasaat aur ilaaqe Pehli Fehrist me naam-zad honge.
The States and the territories thereof shall be as specified in the First Schedule.

1(3). Sarzamiin e Hind me ye ye shaamil honge-
The territory of India shall comprise—

1(3a). Riyaasaat ki sarzamiin;
the territories of the States;

1(3b). Pehli Fehrist me naam-zad kiye gaye Markaz ke ilaaqe; aur
the Union territories specified in the First Schedule; and

1(3c). aese digar ilaaqe jinhe haasil kiya gaya hoga.
such other territories as may be acquired.

2. Nayi Riyaasaat ki shumuliyat ya qayaam. –
Admission or establishment of new States.—

Qaumi Majlis ko jo munaasib lage oon sharaaet aur haalaat par, Nayi Riyaasaat ko qaanuun ke zariye Ittehaad me shaamil, ya qaayam kar sakti hae.
Parliament may by law admit into the Union, or establish, new States on such terms and conditions as it thinks fit.

2A. Mansuukh.
Repealed.

3. Nayi Riyaasaat ki tashkeel aur maujudaah Riyaasaat ke raqbe, sarhad ya naamou me tabdili.-
Formation of new States and alteration of areas, boundaries or names of existing States.—

Qaumi Majlis qaanuun ke zariye-
Parliament may by law—

3(a). kisi bhi Riyaasat se ilaaqe ko alag kar ke ya do ya zyaada Riyaasaat ko jodh kar ya Riyaasaat ke hissou ko jodh kar ya kisi bhi Riyaasat ke hisse me koi bhi ilaaqa jodh kar ek nayi Riyaasat ki tashkeel kar sakti hae;
form a new State by separation of territory from any State or by uniting two or more States or parts of States or by uniting any territory to a part of any State;

3(b). kisi bhi Riyaasat ke raqbe ko badhha sakti hae;
increase the area of any State;

3(c). kisi bhi Riyaasat ke raqbe ko kam kar sakti hae;
diminish the area of any State;

3(d). kisi bhi Riyaasat ki sarhad ko tabdil kar sakti hae;
alter the boundaries of any State;

3(e). kisi bhi Riyaasat ka naam tabdil kar sakti hae:
alter the name of any State:

Shart ye hae ke aesi kisi Tajwiz ko jisme kisi bhi Riyaasat ke raqbe, sarhad ya naam ko muta’assir karne ka koi iraada hou to oose Sadar e Jamhuriya ki sifaarish ke baghaer Qaumi Majlis ke kisi bhi Aewaan me pesh nahi kiya jaa sakta, jiske saath hi ye shart bhi shaamil hae ke jab tak ke Sadar e Jamhuriya ne aesi Tajwiiz ko oos Riyaasat ki Qaanuun-saaz Majlis ke madde nazar nahi kar diya ho taake wo bhi is par apne khayaalaat zaahir kar de, wo bhi oos muddat ke dauraan jo aesi peshkash me wazae ki gayi hou ya phir oos bhi muddat ke dauraan jise Sadar e Jamhuriya ne maziid badhha diya hou aur bil aakhir aesi muddat bhi khatm na ho gayi ho.
Provided that no Bill for the purpose shall be introduced in either House of Parliament except on the recommendation of the President and unless, where the proposal contained in the Bill affects the area, boundaries or name of any of the States, the Bill has been referred by the President to the Legislature of that State for expressing its views thereon within such period as may be specified in the reference or within such further period as the President may allow and the period so specified or allowed has expired.

Wazaahat I.- Is Mazmoon me, nukut 3(a) se 3(e) tak, “Riyaasat” me Markaz ka ilaaqa bhi shaamil hae, lekin usuulan, “Riyaasat” me Markaz ka ilaaqa shaamil nahi hota.
Explanation I.—In this article, in clauses (a) to (e), “State” includes a Union territory, but in the proviso, “State” does not include a Union territory.

Wazaahat II. – Nukut 3(a) ke zariye Qaumi Majlis ko jo ikhteyaar haasil hae usme kisi nayi Riyaasat ya naye Markaz ke ilaaqe ki tashkeel kisi bhi Riyaasat ya Markaz ke ilaaqe ke hisse ko kisi digar Riyaasat ya Markaz ke ilaaqe se jodhkar karna bhi shaamil hae.
Explanation II.—The power conferred on Parliament by clause (a) includes the power to form a new State or Union territory by uniting a part of any State or Union territory to any other State or Union territory.

4. Pehli aur Chauthi Fehrist ko tarmiim karne aur zaaid, fauri aur natijatan masaail ke mutalliq mazmoon 2 aur 3 ke tehet banaaye gaye qawaaniin.-
Laws made under articles 2 and 3 to provide for the amendment of the First and the Fourth Schedules and supplemental, incidental and consequential matters.—

4(1). Mazmoon 2 ya mazmoon 3 me zikr karda kisi bhi qaanuun me Pehli Fehrist aur Chauthi Fehrist ki tarmeem karne ke liye bhi usul shaamil honge, jo ke zarurat ke mutaabiq qaanuun ke usul ko laagu kara sake iske saath hi Qaumi Majlis ko jaesa bhi zaruri lage waese zaaid, fauri aur nataaiji usul bhi shaamil ho sakte hae, (nataaiji usul me Qaumi Majlis aur Riyaasat ki Qaanun-saaz Majlis ya Riyaasaat ki Qaanuun-Saaz Majaalis me numaaindagi par asal daalte usul bhi shaamil honge).
Any law referred to in article 2 or article 3 shall contain such provisions for the amendment of the First Schedule and the Fourth Schedule as may be necessary to give effect to the provisions of the law and may also contain such supplemental, incidental and consequential provisions (including provisions as to representation in Parliament and in the Legislature or Legislatures of the State or States affected by such law) as Parliament may deem necessary.

4(2). Koi bhi qaanuun jiska iske pehle zikr kiya gaya hae oose mazmoon 368 ki garaz se Aain ki tarmeem nahi maana jaaega.
No such law as aforesaid shall be deemed to be an amendment of this Constitution for the purposes of article 368.
