208. Tariqe ke qawaaid.—
Rules of procedure.—

208(1). Is Aain ke Usul ke tehet rehte hue, Riyaasat ki Qaanuun-saaz Majlis ka koi Aewaan chaahe tou apni karwaahi ke tariqe ko munazim karne ke liye qawaaid bana sakta hae.
A House of the Legislature of a State may make rules for regulating, subject to the provisions of this Constitution, its procedure and the conduct of its business.

208(2). Jab tak nukut (1) ke tehet qawaaid nahi bana diye jaate, tab tak Riyaasati Majlis ke Mukallim, ya Riyaasati Shura ke Amiir, jaesa bhi ma’amla ho, inki qaayam ki gayi tabdilaat aur muwaafiqaat ke tehet rehte hue, is Aain ki nafaazat se fauran qabl mutalliq Sube ki Qaanuun-saaz Majlis ke mutalliq tariqe ke jo qawaaid aur oos waqt ke maujuda ahkaamaat jo laagu the wo Riyaasat ki Qaanuun-saaz Majlis ke mutalliq bhi laagu rahenge.
Until rules are made under clause (1), the rules of procedure and standing orders in force immediately before the commencement of this Constitution with respect to the Legislature for the corresponding Province shall have effect in relation to the Legislature of the State subject to such modifications and adaptations as may be made therein by the Speaker of the Legislative Assembly, or the Chairman of the Legislative Council, as the case may be.

208(3). Jis Riyaasat me Riyaasati Shura ho waha Naaziim e Riyaasat chaahe tou, Riyaasati Majlis ke Mukallim aur Riyaasati Shura ke Amiir in dono ke saath mashwara karke, dono Aewaan ke darmeyaan mawaaselaat ke mutalliq qawaaid qaayam kar sakte hae.
In a State having a Legislative Council the Governor, after consultation with the Speaker of the Legislative Assembly and the Chairman of the Legislative Council, may make rules as to the procedure with respect to communications between the two Houses.

209. Riyaasat ki Qaanuun-saaz Majlis me maaliyaati kaarwaahi ke mutalliq tariqe ka qaanuun ke zariye munazzam.—
Regulation by law of procedure in the Legislature of the State in relation to financial business.—

Riyaasat ki Qaanuun-saaz Majlis chaahe tou, maaliyaati kaarwaahi ke mutayyin waqt par mukammal kiye jaane ke liye, Riyaasat ki Qaanuun-saaz Majlis ke kisi bhi maaliyaati ma’amle ke ya Riyaasat ke Majmui Khazaane se raqam makhsus kiye jaane ki kisi bhi Tajwiiz ke tariqe ko ya inki kaarwaahi ke tarze amal ko qaanuun ke zariye munazzim kar sakti hae, aur, agar aese banaaye gaye kisi qaanuun ke kisi usul ka kisi had tak Riyaasat ki Qaanuun-saaz Majlis ke Aewaan ya kisi bhi Aewaan ke mazmoon 208 ke nukut (1) ke tehet banaaye gaye kisi qaanuun ke muwaafiq nahi ho tou ya oosi mazmoon ke nukut (2) ke tehet Riyaasat ki Qaanuun-saaz Majlis par asar karte kisi qaanuun ya maujuda hukm ke muwaafiq nahi ho tou, zikr kiye gaye usul hi laagu rahenge.
The Legislature of a State may, for the purpose of the timely completion of financial business, regulate by law the procedure of, and the conduct of business in, the House or Houses of the Legislature of the State in relation to any financial matter or to any Bill for the appropriation of moneys out of the Consolidated Fund of the State, and, if and so far as any provision of any law so made is inconsistent with any rule made by the House or either House of the Legislature of the State under clause (1) of article 208 or with any rule or standing order having effect in relation to the Legislature of the State under clause (2) of that article, such provision shall prevail.

210. Qaanuun-saaz Majlis me istemaal ki jaane waali Zabaan.—
Language to be used in the Legislature.—

210(1). Hissa XVII ke kisi bhi pehlu ke baawajood, lekin mazmoon 348 ke tehet rehte hue, kisi Riyaasat ki Qaanuun-saaz Majlis ki kaarwaahi oos Riyaasat ki sarkaari zabaan ya zabaanou me ya Hindi ya Angrezi me ki jaayegi:
Notwithstanding anything in Part XVII, but subject to the provisions of article 348, business in the Legislature of a State shall be transacted in the official language or languages of the State or in Hindi or in English:

Shart ye hae ke Riyaasati Majlis ke Mukallim ya Riyaasati Shura ke Amiir, ya koi shakhs jo inki haesiyat se maujud ho, jaesa bhi ma’amla ho, chaahe tou, kisi bhi rukn ko jo munaasib had tak zikr ki gayi kisi bhi zabaan me qalaam nahi karta sakta ho tou oose Aewaan ko ooski maadari-zabaan me khitaab karne ki ijaazat de sakte hae.
Provided that the Speaker of the Legislative Assembly or Chairman of the Legislative Council, or person acting as such, as the case may be, may permit any member who cannot adequately express himself in any of the languages aforesaid to address the House in his mother-tongue.

210(2). Jab tak Riyaasat ki Qaanuun-saaz Majlis iske bar-aks qaanuun ke zariye koi usul nahi qaayam kare tou, is Aain ki nafaazat ke baad se pandhra saal ki muddat khatm ho jaane ke baad, is mazmoon ka asar aesa hoga jaese ke ye alfaaz “ya Angrezi me” oosme se hata diye gaye hou.
Unless the Legislature of the State by law otherwise provides, this article shall, after the expiration of a period of fifteen years from the commencement of this Constitution, have effect as if the words “or in English” were omitted therefrom:

Shart ye hae ke Himaachal Pradesh, Manipur, Meghaalaya aur Tripura Riyaasaat ki Qaanuun-saaz Majaalis ke mutalliq is nukut ka asar aesa hoga jaese ke ye alfaaz “pandhra saal” jo is nukut me darj hae, oonhe in alfaaz “pachchis saal” se mutabaadil kiya gaya ho:
Provided that in relation to the Legislatures of the States of Himachal Pradesh, Manipur, Meghalaya and Tripura this clause shall have effect as if for the words “fifteen years” occurring therein, the words “twenty-five years” were substituted:

Maziid shart ye hae ke Arunaachal Pradesh, Goa, aur Mizoram Riyaasaat ki Qaanuun-saaz Majaalis ke mutalliq is nukut ka asar aesa hoga jaese ke ye alfaaz “pandhra saal” jo is nukut me darj hae, oonhe in alfaaz “chaaliis saal” se mutabaadil kiya gaya ho:
Provided further that in relation to the Legislatures of the States of Arunachal Pradesh, Goa and Mizoram, this clause shall have effect as if for the words "fifteen years" occurring therein, the words "forty years" were substituted.

211. Qaanuun-saaz Majlis me behes par paabandi.—
Restriction on discussion in the Legislature.—

Adaalat e Uzma ya kisi Adaalat e Aaliya ke kisi Qaazi ke onke faraaez ki takmiil ke tarze amal par Riyaasat ki Qaanuun-saaz Majlis me behes nahi karaayi jaa sakti.
No discussion shall take place in the Legislature of a State with respect to the conduct of any Judge of the Supreme Court or of a High Court in the discharge of his duties.

212. Qaanuun-saaz Majlis ki kaarwaahi ki taftiish adaalaat nahi kar sakti.—
Courts not to inquire into proceedings of the Legislature.—

212(1). Riyaasat ki Qaanuun-saaz Majlis ki kisi kaarwaahi ki sehat par kaarwaahi me kisi ilzaami be-qaaidgi ki bina par sawaal nahi oothhaaya ja sakta.
The validity of any proceedings in the Legislature of a State shall not be called in question on the ground of any alleged irregularity of procedure.

212(2). Riyaasat ki Qaanuun-saaz Majlis ka aesa koi bhi afsar ya aesa koi bhi rukn jis par is Aain ke zariye ya iske tehet Riyaasat ki Qaanuun-saaz Majlis me karwaahi ko munazzim karne ke liye ya ooski kaarwaahi ke tarze amal ke liye, ya waha nizaam barkaraar rakhne ke liye ikhteyaar ho, tou ooska oos ikhteyaar ko istemaal ka amal kisi bhi adaalat ke daaeraye kaar me nahi ho sakta.
No officer or member of the Legislature of a State in whom powers are vested by or under this Constitution for regulating procedure or the conduct of business, or for maintaining order, in the Legislature shall be subject to the jurisdiction of any court in respect of the exercise by him of those powers.

Procedure in Financial Matters


202. Saalaana Maaliyaati Tafsiil.—
Annual financial statement.—

202(1). Naazim e Riyaasat har maaliyaati saal ke mutalliq Riyaasat ki Qaanuun-saaz Majlis ke Aewaan ya dono Aewaan ke saamne ek tafsiil rakhwaaenge jisme Riyaasat ke oos saal ke mutawaqqa hasuul aur ikhraajaat honge, is Hisse me oose “Saalaana Maaliyaati Tafsiil” kaha jaayega.
The Governor shall in respect of every financial year cause to be laid before the House or Houses of the Legislature of the State a statement of the estimated receipts and expenditure of the State for that year, in this Part referred to as the “annual financial statement”.

202(2). Saalaana Maaliyaati Tafsiil me shaamil ikhraajaat me darje zeel ma’amlaat ke ikhraajaat ke takhmiine alaahida tarz par waazae kiye jaayenge—
The estimates of expenditure embodied in the annual financial statement shall show separately—

202(2a). jin ikhraajaat ki wazaahat is Aain ke zariye you ki gayi hae ke unki adaayegi Riyaasat ke Majmui Khazaane se ki jaayegi oon ikhraajaat ki adaayegi ke liye jo raqam hogi oosko; aur
the sums required to meet expenditure described by this Constitution as expenditure charged upon the Consolidated Fund of the State; and

202(2b). jin digar ikhraajaat ki adaayegi ko Riyaasat ke Majmui Khazaane se kiye jaane ka iraada kiya gaya hae oon ikhraajaat ki adaayegi ke liye jo raqam hogi oosko, aur aamdani ke khaate me in ikhraajaat ko digar ikhraajaat se alaahida rakha jaayega.
the sums required to meet other expenditure proposed to be made from the Consolidated Fund of the State; and shall distinguish expenditure on revenue account from other expenditure.

202(3). Darje zeel ikhraajaat wo honge jinki adaayegi Riyaasat ke Majmui Khazaane se ki jaayegi—
The following expenditure shall be expenditure charged on the Consolidated Fund of each State—

202(3a). Naazim e Riyaasat ke munaafe aur tankhwaah aur onke daftar ke digar ikhraajaat;
the emoluments and allowances of the Governor and other expenditure relating to his office;

202(3b). Riyaasati Majlis ke Mukallim aur Naaeb Mukallim inki ujrat aur tankhwaah aur, tab jab Riyaasat me Riyaasati Shura bhi ho tou, Riyaasati Shura ke Amiir aur Naaeb Amiir inki bhi ujrat aur tankhwaah;
the salaries and allowances of the Speaker and the Deputy Speaker of the Legislative Assembly and, in the case of a State having a Legislative Council, also of the Chairman and the Deputy Chairman of the Legislative Council;

202(3c). wo karz jiski zimmedaar Riyaasat hae oon karz ki suud samet adaayegi ki raqam, sikudte khazaane ki adaayegi ki raqam aur karz se nijaat ki raqam, aur karz lene aur karz se mutalliq khidmat aur nijaat ki raqam;
debt charges for which the State is liable including interest, sinking fund charges and redemption charges, and other expenditure relating to the raising of loans and the service and redemption of debt;

202(3d) kisi bhi Adaalat e Aalia ke qazaat ke mutalliq ya oonko ada karda ujrat, tankhwaah aur wazaaif ke mutalliq ikhraajaat;
expenditure in respect of the salaries and allowances of Judges of any High Court;

202(3e). kisi adaalat ya kisi saalisi daad-gaah ke kisi mumakkal faesle, aarzi faesle ya daad-gaah ke faesle ki takmiil kiye jaane ke liye laazimi raqam;
any sums required to satisfy any judgment, decree or award of any court or arbitral tribunal;

202(3f). is Aain ke zariye ya Riyaasat ki Qaanuun-saaz Majlis qaanuun ke zariye kisi digar ikhraajaat ki adaayegi ki wazaahat kar de tou ooski raqam.
any other expenditure declared by this Constitution, or by the Legislature of the State by law, to be so charged.

203. Takhmiinou ke mutalliq Qaanuun-saaz Majlis me tariqa.—
Procedure in Legislature with respect to estimates.—

203(1). Jitne ikhraajaat ki adaayegi ki raqam Riyaasat ke Majmui Khazaane se ada ki jaani hae oonke takhminou par Riyaasati Majlis me raae shumaari nahi ki jaayegi, lekin is nukut ke kisi bhi pehlu ke ye maaene nahi hae oon takhminou par Qaanuun-saaz Majlis behes nahi karaayi jaa sakti.
So much of the estimates as relates to expenditure charged upon the Consolidated Fund of a State shall not be submitted to the vote of the Legislative Assembly, but nothing in this clause shall be construed as preventing the discussion in the Legislature of any of those estimates.

203(2). Jitne digar ikhraajaat se mutalliq takhmine honge oonhe atiyaat ke mutaalbaat ki shakal me Riyaasati Majlis ke saamne rakha jaayega, aur Riyaasati Majlis ka kisi bhi mutaalbe ko raza dene ka ya raza nahi dene ka ikhteyaar hoga, ya Riyaasati Majlis ka kisi mutaalbe ko is surat me ke oos mutaalbe me jo raqam wazae ki gayi hae oose ghataya jaaye tou, oose raza dene ka ikhteyaar hoga.
So much of the said estimates as relates to other expenditure shall be submitted in the form of demands for grants to the Legislative Assembly, and the Legislative Assembly shall have power to assent, or to refuse to assent, to any demand, or to assent to any demand subject to a reduction of the amount specified therein.

203(3). Naazim e Riyaasat ki sifaarish ke baghaer kisi bhi atiye ka mutaalba nahi kiya jaa sakta.
No demand for a grant shall be made except on the recommendation of the Governor.

204. Makhsuus kiye jaane ke liye Tajwizaat.—
Appropriation Bills.—

204(1). Jab mazmoon 203 ke tehet Riyaasati Majlis atiyaat par raza mand ho jaaye tou, jald az jald darje zeel ma’amlaat me ada kiye jaane ke liye zaruri raqam ko Riyaasat ke Majmui Khazaane me makhsuus kiye jaane ke liye ek Tajwiiz pesh ki jaayegi—
As soon as may be after the grants under article 203 have been made by the Assembly, there shall be introduced a Bill to provide for the appropriation out of the Consolidated Fund of the State of all moneys required to meet—

204(1a). jin atiyaat par Riyaasati Majlis raza mand hou; aur
the grants so made by the Assembly; and

204(1b). Riyaasat ke Majmui Khazaane se ada karda ikhraajaat lekin kisi bhi ma’amle me isse qabl Aewaan ya donohi Aewaan ke saamne jo tafsiil rakhi gayi ho osme waazae ki gayi raqam ko badhaaya nahi jaa sakta.
the expenditure charged on the Consolidated Fund of the State but not exceeding in any case the amount shown in the statement previously laid before the House or Houses.

204(2). Aesi Tajwiiz me aesi tarmeem ka iraada Riyaasat ki Qaanuun-saaz Majlis ke Aewaan ya kisi bhi Aewaan me nahi kiya jaa sakta jiske natije me aese kisi bhi atiye ki raqam ya ooski manzil me koi tabdiili ki jaaye ya Riyaasat ke Majmui Khazaane se ada karda ikhraajaat ki raqam me koi tabdiili ki jaaye, aur wo shakhs jo is mutalliq ke koi tarmeem is nukut ke tehet ki ja sakti hae ya nahi is par sadaarat kar rahe hou tou oonka faesla hatami hoga.
No amendment shall be proposed to any such Bill in the House or either House of the Legislature of the State which will have the effect of varying the amount or altering the destination of any grant so made or of varying the amount of any expenditure charged on the Consolidated Fund of the State, and the decision of the person presiding as to whether an amendment is inadmissible under this clause shall be final.

204(3). Mazaameen 205 aur 206 ke usul ke tehet, Riyaasat ke Majmui Khazaane se koi bhi raqam nikaali nahi jaa sakti siwaaye oos makhsuusiyat ke tehet jo is mazmoon ke usul ke mutaabiq qaanuun ke zariye manzuur ki gayi hou.
Subject to the provisions of articles 205 and 206, no money shall be withdrawn from the Consolidated Fund of the State except under appropriation made by law passed in accordance with the provisions of this article.

205. Zimni, maziid ya zaaid atiyaat.—
Supplementary, additional or excess grants.—

205(1). Naazim e Riyaasat chaahe tou—
The Governor shall—

205(1a). agar mazmoon 204 ke usul ke mutaabiiq qaanuun ke zariye kisi makhsuus khidmat ke kharch ke liye jo raqam maujuda maaliyaati saal ke liye mukarrar ki gayi hou wo oos saal le maqaasid ke liye na kaafi paayi jaaye ya maujuda maaliyaati saal ke dauraan zimni ya maziid ikhraajaat ki zarurat ho jaaye jo kisi aesi nayi khidmat par mubani ho jispar oos saal ke saalaana maaliyaati tafsiil me tawajjo me nahi liya gaya ho tou, ya
if the amount authorised by any law made in accordance with the provisions of article 204 to be expended for a particular service for the current financial year is found to be insufficient for the purposes of that year or when a need has arisen during the current financial year for supplementary or additional expenditure upon some new service not contemplated in the annual financial statement for that year, or

205(1b). agar kisi maaliyaati saal ki kisi khidmat ke liye oos saal jo raqam makhsuus ki gayi ho aur oosi saal oos khidmat par makhsuus raqam se zaaid raqam kharch ki jaa chuki ho tou,
if any money has been spent on any service during a financial year in excess of the amount granted for that service and for that year,

Sadar e Jamhuriya digar ek tafsiil Riyaasat ki Qaanuun-saaz Majlis ke Aewaan ya dono Aewaan ke saamne rakhwaaenge jisme aese ikhraajaat ki mutawaqqo raqam waazae kigayi hogi ya Riyaasat ki Riyaasati Majlis ke saamne aesi zaaid raqam ke liye mutaalba karwaaenge, jaesa bhi ma’amla ho.
cause to be laid before the House or the Houses of the Legislature of the State another statement showing the estimated amount of that expenditure or cause to be presented to the Legislative Assembly of the State a demand for such excess, as the case may be. 

205(2). Mazaameen 202, 203 aur 204 ke usul aesi kisi bhi tafsiil aur ikhraajaat ya mutaalbe par laagu honge aur aese kisi bhi banaaye gaye qaanuun par laagu honge jo Riyaasat ke Majmui Khazaane se aese ikhraajaat ki adaayegi ya aese kisi atiye ke mutalliq mutaalbe ke tehet raqam makhsus kiye jaane ka ikhteyaar deta ho aur ye usul inpar waese se hi laagu honge, jaese ke saalaana maaliyaati tafsiil ya oosme wazae kiye gaye ikhraajaat ya atiye ke mutaalbe aur aese ikhraajaat ya atiye ki adaayegi ke liye Riyaasat ke Majmui Khazaane se raqam makhsus karne ka ikhteyaar dene ke liye banaaye gaye qaanuun, in tamaam par laagu hote hou.
The provisions of articles 202, 203 and 204 shall have effect in relation to any such statement and expenditure or demand and also to any law to be made authorising the appropriation of moneys out of the Consolidated Fund of the State to meet such expenditure or the grant in respect of such demand as they have effect in relation to the annual financial statement and the expenditure mentioned therein or to a demand for a grant and the law to be made for the authorisation of appropriation of moneys out of the Consolidated Fund of the State to meet such expenditure or grant.

206. Peshgi atiyaat, Naagahaani atiyaat aur imtiyaazi atiyaat.—
Votes on account, votes of credit and exceptional grants.—

206(1). Is baab ke kisi bhi maujuda usul ke baawajood, Riyaasat ki Riyaasati Majlis ka ikhteyaar hoga ke—
Notwithstanding anything in the foregoing provisions of this Chapter, the Legislative Assembly of a State shall have power—

206(1a). kisi maaliyaati saal ki juzwi muddat ke mutawaqqou ikhraajaat ke liye aese peshgi atiye ki adaayegi kar sakta hou jinpar aese atiyaat ki adaayegi ke mutalliq mazmoon 203 ke mutaabiq raae shumaari ke tariqae kaar ki takmiil ruki hui ho aur mazmoon 204 ke usul ke mutaabiq oon ikhraajaat ke mutalliq qaanuun ki manzuuri ruki hui ho.
to make any grant in advance in respect of the estimated expenditure for a part of any financial year pending the completion of the procedure prescribed in article 203 for the voting of such grant and the passing of the law in accordance with the provisions of article 204 in relation to that expenditure;

206(1b). wo aese atiye ki adaayegi kar sakta hae jo kisi naagahaani zaururat se nipatne ke liye hou tab jab wo naagahaani zarurat Riyaasat ke wasaail par asar kar rahi hou aur jab khidmat ki shiddat aur mubham sifat ki wajaah se ooske liye mutaalbe ki tafsiilaat aam tarz par saalaana maaliyaati tafsiil me waazae nahi ki jaa sakti hou;
to make a grant for meeting an unexpected demand upon the resources of the State when on account of the magnitude or the indefinite character of the service the demand cannot be stated with the details ordinarily given in an annual financial statement;

206(1c). wo kisi imtiyaazi atiye ki adaayegi kar sakta hae jo kisi bhi maaliyaati saal ki maujuda khidmat ka hissa nahi ho;
to make an exceptional grant which forms no part of the current service of any financial year;

aur Riyaasat ki Qaanuun-saaz Majlis ko ye ikhteyaar hoga ke wo oon maqaasid ke liye jinke liye atiyaat ko mukarrar kiya gaya ho oonke mutalliq raqam ki adaayegi ke liye Riyaasat ke Majmui Khazaane se raqam ke hasul ko durust karaar de.
and the Legislature of the State shall have power to authorise by law the withdrawal of moneys from the Consolidated Fund of the State for the purposes for which the said grants are made.

206(2). Mazaameen 203 aur 204 ke usul in par laagu honge, nukut (1) ke tehet mukarrar kiye gaye kisi atiye ke mutalliq, aur oos nukut ke tehet banaaye gaye kisi qaanuun par, ye usul in par waese hi laagu honge jaese ke ye darje zeel par laagu hote hae, saalaana maaliyaati tafsiil me waazae kiye gaye kisi ikhraajaat ke liye mukarrar kiye gaye atiye par, aur aese ikhraajaat ki adaayegi ke liye Riyaasat ke Majumui Khazaane se makhsus ki gayi kisi raqam ke ikhteyaar par.
The provisions of articles 203 and 204 shall have effect in relation to the making of any grant under clause (1) and to any law to be made under that clause as they have effect in relation to the making of a grant with regard to any expenditure mentioned in the annual financial statement and the law to be made for the authorisation of appropriation of moneys out of the Consolidated Fund of the State to meet such expenditure.

207. Maaliyati Tajwiizaat ke mutalliq makhsuus usul.—
Special provisions as to financial Bills.—

207(1). Mazmoon 199 ke nukut (1) ke zere nukut (a) se (f) tak me waazae kiye gaye kisi bhi ma’amle ke mutalliq usul qaayam karne ke liye Naaziim e Riyaasat ki sifaarish ke baghaer koi Tajwiiz ki ibteda ya tarmiin ki muntaqli nahi ki jaa sakti aur aese usul ke mutalliq kisi bhi Tajwiiz ki ibteda Riyaasati Shura me nahi ki jaa sakti:
A Bill or amendment making provision for any of the matters specified in sub-clauses (a) to (f) of clause (1) of article 199 shall not be introduced or moved except on the recommendation of the Governor, and a Bill making such provision shall not be introduced in a Legislative Council:

Shart ye hae ke is nukut ke tehet aesi kisi tarmiin ki muntaqli ke liye kisi sifaarish ki zarurat nahi hogi jo kisi zarb ko kam karne ya khatm karne ke liye usul banaane ke mutalliq ho.
Provided that no recommendation shall be required under this clause for the moving of an amendment making provision for the reduction or abolition of any tax.

207(2). A Bill or amendment shall not be deemed to make provision for any of the matters aforesaid by reason only that it provides for the imposition of fines or other pecuniary penalties, or for the demand or payment of fees for licences or fees for services rendered, or by reason that it provides for the imposition, abolition, remission, alteration or regulation of any tax by any local authority or body for local purposes.

207(3). Agar koi Tajwiiz naafez kiye jaane ke baad aur laagu kiye jaane ke baad aesi ho ke ooska asar Riyaasat ke Maujmui Khazaane ke ikhraajaat par hoga tou aesi Tajwiiz ko Riyaasati Majlis ka koi Aewaan tab tak manzuur nahi kar sakta jab tak ke Naaziim e Riyaasat ne oos Aewaan ko oos Tajwiiz par ghaur o fikr karne ki sifaarish na ki ho.
A Bill which, if enacted and brought into operation, would involve expenditure from the Consolidated Fund of a State shall not be passed by a House of the Legislature of the State unless the Governor has recommended to that House the consideration of the Bill.

196. Tajwizaat ko pesh karne ka aur oonko manzuur karne ke usul.—
Provisions as to introduction and passing of Bills.—

196(1). Maali Tajwiiz aur digar maaliyaati Tajwizaat ke mutalliq mazaameen 198 aur 207 ke usul ke tehat rehte hue, kisi bhi Tajwiiz ki ibteda jin Riyaasat me Riyaasati Shura hae waha ki Qaanuun-saaz Majlis ke dono me se kisi bhi Aewaan me ho sakti hae.
Subject to the provisions of articles 198 and 207 with respect to Money Bills and other financial Bills, a Bill may originate in either House of the Legislature of a State which has a Legislative Council.

196(2). Mazaameen 197 aur 198 ke usul ke tehat rehte hue, kisi bhi Tajwiiz ko oos waqt tak jin Riyaasaat me Riyaasati Shura hae oski Qaanuun-saaz Majlis ke donohi Aewaan se manzuur shuda nahi maana jaayega, jab tak ke oos Tajwiiz ko donohi Aewaan ki manzuuri naa mil jaaye, aur manzuuri ya tou baghaer kisi tarmiin ke hou ya utni hi taraamiin ki had tak hou jitni taraamiin par donohi Aewaan muttafiq ho.
Subject to the provisions of articles 197 and 198, a Bill shall not be deemed to have been passed by the Houses of the Legislature of a State having a Legislative Council unless it has been agreed to by both Houses, either without amendment or with such amendments only as are agreed to by both Houses.

196(3). Riyaasat ki Qaanuun-saaz Majlis me koi bhi Tajwiiz jo zere ghaur ho tou oose Aewaan ke multawi kiye jaane ki bina par radd nahi maana jaayega.
A Bill pending in the Legislature of a State shall not lapse by reason of the prorogation of the House or Houses thereof.

196(4). Kisi Riyaasat ke Riyaasati Shura me koi bhi Tajwiiz jo zere ghaur ho aur jise Aewaan e Awaam ne manzuur nahi kiya huwa ho tou oose Aewaan e Awaam ka ikhtetaam ho jaane ki bina par radd nahi maana jaayega.
A Bill pending in the Legislative Council of a State which has not been passed by the Legislative Assembly shall not lapse on a dissolution of the Assembly.

196(5). Riyaasati Majlis me koi bhi Tajwiiz jo zere ghaur ho, ya jise Riyaasati Majlis ne manzuur kar liya ho par wo Riyaasaati Shura me zere ghaur ho, tou Riyaasati Majlis ka ikhtetaam ho jaane par oose radd maana jaayega.
A Bill which is pending in the Legislative Assembly of a State, or which having been passed by the Legislative Assembly is pending in the Legislative Council, shall lapse on a dissolution of the Assembly.

197. Maali Tajwiizaat ke alaawa digar Tajwiizaat ke mutalliq Riyaasati Shura ke ikhteyaaraat ke hudud.—
Restriction on powers of Legislative Council as to Bills other than Money Bills.—

197(1). Jis Riyaasat me Riyaasati Shura ho agar oos Riyaasat ki Riyaasati Majlis koi Tajwiiz ko manzuur karde aur ooske baad Riyaasati Shura me muntaqil karde, fir— 
If after a Bill has been passed by the Legislative Assembly of a State having a Legislative Council and transmitted to the Legislative Council— 

197(1a). Shura oos Tajwiiz ko na-manzuur kar de; ya 
the Bill is rejected by the Council; or

197(1b). jis taarikh ko Tajwiiz ko Shura ke saamne pesh kiya gaya tha oos taarikh se tiin maah se zaaid ka muddat guzar chuki ho aur Shura ne oos Tajwiiz ko tab tak manzuur nahi kiya ho; ya
more than three months elapse from the date on which the Bill is laid before the Council without the Bill being passed by it; or

197(1c). Shura ne oos Tajwiiz ko aesi taraameem ke saath manzuur kiya ho jin par Riyaasati Majlis raazi na ho;
the Bill is passed by the Council with amendments to which the Legislative Assembly does not agree;

tou, Riyaasati Majlis chaahe tou, ooske tariqe ki nizaamat karte qawaaiid ke tehet rehte huwe, Tajwiiz ko oosi ijlaas me ya baad ke kisi ijlaas me, Riyaasati Shura ki, ki hui, ya ooski mashwara di hui ya jispar bhi Riyaasati Shura ne raza di thi, aesi taraameem ke saath ya aesi taraameem ke baghaer hi Tajwiiz ko manzur kar sakti hae, aur fir oos Tajwiiz ko oski manzuur shuda haalat me Riyaasati Shura me muntaqil kar sakti hai.
the Legislative Assembly may, subject to the rules regulating its procedure, pass the Bill again in the same or in any subsequent session with or without such amendments, if any, as have been made, suggested or agreed to by the Legislative Council and then transmit the Bill as so passed to the Legislative Council.

197(2). Agar is tarha se Tajwiiz ko Riyaasati Majlis ne dobaara manzuur kar liye ho aur oos Tajwiiz ko Riyaasati Shura me muntaqil kar diya hou, aur—
If after a Bill has been so passed for the second time by the Legislative Assembly and transmitted to the Legislative Council—

197(2a) Riyaasati Shura ne Tajwiiz ko na-manzuur kar diya; ya
the Bill is rejected by the Council; or

197(2b) jis taarikh ko Tajwiiz ko Shura ke saamne pesh kiya gaya tha oos taarikh se ek maah se zaaid ki muddat guzar chuki ho aur Shura ne oos Tajwiiz ko tab tak manzuur nahi kiya ho; ya
more than one month elapses from the date on which the Bill is laid before the Council without the Bill being passed by it; or

197(2c). Shura ne Tajwiiz ko aesi taraameen ke saath manzuur kiya ho jinpar Riyaasati Majlis raazi nahi ho;
the Bill is passed by the Council with amendments to which the Legislative Assembly does not agree;

tou, Tajwiiz ko Riyaasat ki Qaanuun-saaz Majlis se manzur shuda maana jaayega oos haalat me jaesa ke Riyaasati Majlis ne oos Tajwiiz ko dobaara manzur kiya tha, agar Riyaasati Shura ki, ki hui, ya ooski mashwara di hui ya jispar bhi Riyaasati Shura ne raza di thi, aesi taraameem ho tou, aur oon taraameem ko Riyaasati Majlis ne bhi raza di ho.
the Bill shall be deemed to have been passed by the Houses of the Legislature of the State in the form in which it was passed by the Legislative Assembly for the second time with such amendments, if any, as have been made or suggested by the Legislative Council and agreed to by the Legislative Assembly.

197(3). Is mazmoon ka koi bhi pehlu Maali Tajwiiz par laagu nahi ho sakta.
Nothing in this article shall apply to a Money Bill.

198. Maali Tajwizaat ke mutalliq makhsuus tariqa.—
Special procedure in respect of Money Bills.—

198(1). Riyaasaati Shura me Maali Tajwiiz ki ibteda nahi ki jaa sakti.
A Money Bill shall not be introduced in a Legislative Council.

198(2). Jis Riyaasat me Riyaasati Shura ho tou oos Riyaasat me Maali Tajwiiz ke Riyaasati Majlis me manzuur kiye jaane ke baad oose Riyaasati Shura me muntaqil kiya jaana hoga aur Riyaasati Shura oos Maali Tajwiiz ko haasil karne ki taarikh se chaudaah din ki muddat me oos Maali Tajwiiz ko apni sifaarishaat ke saath dobaara Riyaasati Majlis ko lauta dega aur Riyaasati Majlis chaahe tou Riyaasati Shura ki oon sifaarishaat me se tamaam ya kuch ko qubul ya radd kar sakta hae.
After a Money Bill has been passed by the Legislative Assembly of a State having a Legislative Council, it shall be transmitted to the Legislative Council for its recommendations, and the Legislative Council shall within a period of fourteen days from the date of its receipt of the Bill return the Bill to the Legislative Assembly with its recommendations, and the Legislative Assembly may thereupon either accept or reject all or any of the recommendations of the Legislative Council.

198(3). Agar Riyaasati Majlis Riyaasati ki kisi bhi sifaarish ko qubul kar le tou, oon taraameen ke saath jinki sifaarish Riyaasati Shura ne ki hou wo Maali Tajwiiz donohi Aewaan se manzuur shuda maani jaayegi.
If the Legislative Assembly accepts any of the recommendations of the Legislative Council, the Money Bill shall be deemed to have been passed by both Houses with the amendments recommended by the Legislative Council and accepted by the Legislative Assembly.

198(4). Agar Riyaasati Majlis Riyaasati Shura ki kisi bhi sifaarish ko qubul nahi kare tou, baghaer kisi aesi taraameen ke jiski sifaarish Riyaasati Shura ne ki ho aur oosi haalat me jaese oose Riyaasati Majlis me manzuur kiya gaya tha wo Maali Tajwiiz donohi Aewaan se manzur shuda maani jaayegi.
If the Legislative Assembly does not accept any of the recommendations of the Legislative Council, the Money Bill shall be deemed to have been passed by both Houses in the form in which it was passed by the Legislative Assembly without any of the amendments recommended by the Legislative Council.

198(5). Agar koi Maali Tajwiiz Riyaasati Majlis me manzuur ki jaane ke baad Riyaasati Shura me ooski sifaarishaat haasil karne ke liye muntaqil ki jaati hae aur bataayi gayi chaudaah din ki muddat ke darmeyaan dobaara Riyaasati Majlis ko lautaayi nahi jaati tou, oos muddat ke khatm ho jaane par oos Maali Tajwiiz ko oosi haalat me jaesa ke oose Riyaasati Majlis me manzuur kiya gaya tha oose donohi Aewaan se manzuur shuda maana jaaye ga.
If a Money Bill passed by the Legislative Assembly and transmitted to the Legislative Council for its recommendations is not returned to the Legislative Assembly within the said period of fourteen days, it shall be deemed to have been passed by both Houses at the expiration of the said period in the form in which it was passed by the Legislative Assembly.

199. “Maali Tajwizaat” ka khulaasa.—

Definition of “Money Bills”.—

199(1). Is baab ke maqaasid ke tehat, kisi bhi Tajwiiz ko Maali Tajwiiz maana jaayega agar oosme mehez darje zeel ma’amlaat me se tamaam ya kuch ke mutalliq usul hou, jaese ke:—
For the purposes of this Chapter, a Bill shall be deemed to be a Money Bill if it contains only provisions dealing with all or any of the following matters, namely:—

199(1a) kisi bhi zarb ko aaid karne, oosko khatm karne, oosme kami karne, oosme tabdiili karne ya oosko munazzim karne ke mutalliq hou;
the imposition, abolition, remission, alteration or regulation of any tax;

199(1b) Riyaasat ke maali karz lene ya koi zamaanat lene ki nizaamat ke mutalliq hou ya Riyaasat ki kisi bhi maaliyaati taqaazaat ki li gayi ya li jaane waali zimmedaari ke mutalliq hou;
the regulation of the borrowing of money or the giving of any guarantee by the State, or the amendment of the law with respect to any financial obligations undertaken or to be undertaken by the State;

199(1c) Riyaasat ke Maujmui Khazaane ya Hangaami Khazaane ki tehwiil ke mutaaliq hou, aesi kisi Khazaane me maal jama karne ya oosme se maal nikaalne ke mutalliq hou;
the custody of the Consolidated Fund or the Contingency Fund of the State, the payment of moneys into or the withdrawal of moneys from any such Fund;

199(1d) Riyaasat ke Majmui Khazaane me se maal ke tasarruf ke mutalliq hou;
the appropriation of moneys out of the Consolidated Fund of the State;

199(1e) kisi kharch ko Riyaasat ke Majmui Khazaane par aaid kharch you aelaan karne ke mutalliq hou ya aese kisi kharch ki raqam ko badhhaane ke mutalliq hou;
the declaring of any expenditure to be expenditure charged on the Consolidated Fund of the State, or the increasing of the amount of any such expenditure;

199(1f) Riyaasat ke Majmui Khazaane ke khaate me ya Riyaasat ke awaami khaate me maal jama karne ke mutalliq hou ya aese maal ki tehwiil ya oose ada karne ke mutalliq hou; ya
the receipt of money on account of the Consolidated Fund of the State or the public account of the State or the custody or issue of such money; or

199(1g) zere nukut (a) se lekar (f) tak me darj ma’amlaat se zimni kisi ma’amle ke mutalliq hou.
any matter incidental to any of the matters specified in subclauses (a) to (f).

199(2). Kisi bhi Tajwiiz ko mehez is bina par ke wo jurmanou ya digar jurmaanou ki saza ke mutalliq usul rakhti hou ya wo ijaazat naamou ke liye ya faraaham ki hui kisi khidmat ke aewaz raqam ka mutaalba ya raqam ki adaaegi ke mutalliq usul rakhti hou, ya wo ilaaqaayi maqaasid ke liye kisi ilaaqaayi mehkame ya idaare ke zariye kisi zarb ke aaid kiye jaane ke liye, oose khatm kiye jaane ke liye, oosme kami kiye jaane ke liye ya oosko munazzim kiye jaane ke liye koi usul rakhti hae tou, oos Tajwiiz ko Maali Tajwiiz nahi maana jayega.

199(3). Agar ye sawaal uthhtaa hae ke koi Tajwiiz jise kisi Riyaasat ki Qaanuun-saaz majlis me pesh kiya gaya ho ke wo Maali Tajwiiz hae ya nahi tou, ispar oos Riyaasat ki Riyaasati Majlis ke Mukallim ka faesla hatami hoga.
If any question arises whether a Bill introduced in the Legislature of a State which has a Legislative Council is a Money Bill or not, the decision of the Speaker of the Legislative Assembly of such State thereon shall be final.

199(4). Har Maali Tajwiiz par, jab oose mazmoon 198 ke tehet Riyaasati Shura ko muntaqil kiya jaaye, aur jab mazmoon 198 ke tehet oos Maali Tajwiiz par Naazim e Riyaasat ki raza haasil karne ke liye oonke saamne pesh kiya jaaye tou, oos Maali Tajwiiz par sadaaqat naame ki tauseeq honi chaahiye, jis sadaaqat naame par Riyaasati Majlis ke Mukallim ne khud dastakhat karke ye tasdeeq ki ho ke wo ek Maali Tajwiiz hae.
There shall be endorsed on every Money Bill when it is transmitted to the Legislative Council under article 198, and when it is presented to the Governor for assent under article 200, the certificate of the Speaker of the Legislative Assembly signed by him that it is a Money Bill.

200. Tajwiizaat par Raza.—
Assent to Bills.—

Jab koi Tajwiiz Riyaasat ki Riyaasati Majlis se manzuur shuda ho chuki ho tou, ya agar kisi Riyaasat me Riyaasati Shura bhi ho tou, Riyaasat ki Qaanuun-saaz Majlis ke donohi Aewaan se manzuur shuda ho chuki ho tou, oos Tajwiiz ko Naazim e Riyaasat ke samne pesh kiya jaayega, aur Naazim e Riyaasat ye aelaan karenge ke oonhone oos Tajwiiz ko oonki raza de di hae, ya oonhone oos Tajwiiz par oonki raza ko rok li hae ya oonhone Sadar e Jamhuriya ki madde nazar ke liye oos Tajwiiz ko makhsus kar liya hae:
When a Bill has been passed by the Legislative Assembly of a State or, in the case of a State having a Legislative Council, has been passed by both Houses of the Legislature of the State, it shall be presented to the Governor and the Governor shall declare either that he assents to the Bill or that he withholds assent therefrom or that he reserves the Bill for the consideration of the President:

Provided that the Governor may, as soon as possible after the presentation to him of the Bill for assent, return the Bill if it is not a Money Bill together with a message requesting that the House or Houses will reconsider the Bill or any specified provisions thereof and, in particular, will consider the desirability of introducing any such amendments as he may recommend in his message and, when a Bill is so returned, the House or Houses shall reconsider the Bill accordingly, and if the Bill is passed again by the House or Houses with or without amendment and presented to the Governor for assent, the Governor shall not withhold assent therefrom:

Provided further that the Governor shall not assent to, but shall reserve for the consideration of the President, any Bill which in the opinion of the Governor would, if it became law, so derogate from the powers of the High Court as to endanger the position which that Court is by this Constitution designed to fill.

201. Maade nazar ki garaz se makhsuus ki gayi Tajwiizaat.—
Bills reserved for consideration.—

Jab kisi Tajwiiz ko Naazim e Riyaasat Sadar e Jamhuriya ki madde nazar ke liye makhsuus kar de tou, Sadar e Jamhuriya ye aelaan karenge ke oonhone oos Tajwiiz ko oonki raza de di hae, ya oonhone oos Tajwiiz par oonki raza ko rok li hae:
When a Bill is reserved by a Governor for the consideration of the President, the President shall declare either that he assents to the Bill or that he withholds assent therefrom:

Shart ye hae ke, Jab Tajwiiz Maali Tajwiiz nahi ho tou, Sadar e Jamhuriya chaahe tou Naazim e Riyaasat ko ye hidaayat de sakte hae ke Naazim e Riyaasat oos Tajwiiz ko Aewaan ko lauta de ya, jaesa bhi ma’amla hou, Riyaasat ki Qaanuun-saaz Majlis ke donohi Aewaan ko lauta de, aese paighaam ke saath jiska zikr mazmoon 200 ke pehle usul me kiya gaya hae aur, jab oos Tajwiiz ko is tariqe se lautaaya gaya ho tou, oos Tajwiiz ko aese paighaam ke saath jis taarikh ko dobaara lauta gaya hou oos taarikh se che maah ki muddat ke darmeyaan, Aewaan ya donohi Aewaan oos Tajwiiz par oos mutaabiq dobaara ghaur o fikr karenge, aur agar oos Tajwiiz ko Aewaan ya donohi Aewaan dobaara tarmeem ke saath ya tarmeem ke baghaer manzur shuda kar de tou, oos Tajwiiz ko dobaara Sadar e Jamhuriya ke saamne oonki madde nazar ke liye pesh kiya jaayega.
Provided that, where the Bill is not a Money Bill, the President may direct the Governor to return the Bill to the House or, as the case may be, the Houses of the Legislature of the State together with such a message as is mentioned in the first proviso to article 200 and, when a Bill is so returned, the House or Houses shall reconsider it accordingly within a period of six months from the date of receipt of such message and, if it is again passed by the House or Houses with or without amendment, it shall be presented again to the President for his consideration.

194. Qaanuun-saaz Majaalis ke Aewaan ke aur iske Araakeen ke aur iske Wafaazaat ke Ikteyaaraat, imtiyaazaat wagahera.—
Powers, privileges, etc., of the Houses of Legislatures and of the members and committees thereof.—

194(1). Is Aain ke usul aur Qaanuun-saaz Majlis ke tariqe ko munazzim karaate laagu ahkaam aur qawaaid ke tehat, har ek Riyaasaat ki Qaanuun-saaz Majlis me bolne ki aazaadi hogi.
Subject to the provisions of this Constitution and to the rules and standing orders regulating the procedure of the Legislature, there shall be freedom of speech in the Legislature of every State.

194(2). Kisi Riyaasat ki Qaanuun-saaz Majlis ke kisi bhi rukn ko Qaanuun-saaz Majlis me ya ooske kisi Wafaz me koi bhi baat bolne ya koi bhi raae dene ke mutalliq kisi bhi adaalat ki kisi bhi kaarwaahi me zimmedaar nahi banaaya jaa sakta, aur Qaanuun-saaz Majlis ke kisi Aewaan ya ooske tehat kisi mehkame ke shaae-karda kisi natije, dastaawez, raae ya kaarwaahi ke mutalliq kisi bhi shakhs ko zimmedaar nahi banaaya jaa sakta.
No member of the Legislature of a State shall be liable to any proceedings in any court in respect of anything said or any vote given by him in the Legislature or any committee thereof, and no person shall be so liable in respect of the publication by or under the authority of a House of such a Legislature of any report, paper, votes or proceedings.

194(3). Digar ma’amlaat me, kisi Riyaasat ki Qaanuun-saaz Majlis ke kisi Aewaan ke, aur ooske araakeen ke aur wafaazaat ke ikhteyaaraat, imtiyaazaat aur istesnaat aese honge jaese ke oonki waqt ba waqt Qaanuun-saaz Majlis qaanuun ke zariye wazaahat karegi, aur, jab tak aesi wazaahat nahi ki jaati, tab tak oos Aewaan ke aur ooske araakeen ke aur ooske wafaazaat ke ikhteyaaraat, imtiyaazaat aur istesnaat waesehi rahenge jaese ke 1978, Aaini Qaide (Chauwwaaliswi Tarmeem) ke juz 26 ke laagu hone se fauran qabl rahe the.
In other respects, the powers, privileges and immunities of a House of the Legislature of a State, and of the members and the committees of a House of such Legislature, shall be such as may from time to time be defined by the Legislature by law, and, until so defined, shall be those of that House and of its members and committees immediately before the coming into force of section 26 of the Constitution (Forty-fourth Amendment) Act, 1978.

194(4). Nukut (1), (2) aur (3) ke usul oos shakhs par, is Aain ki badaulat oos shakhs ko aata kiye gaye, kisi Riyaasat ki Qaanuun-saaz Majlis ke kisi Aewaan ya ooske kisi Wafaz me oos shakhs ke bolne ke haq ya iske alaawa oos shakhs ke kaarwaahi me hissa lene ke haq par, zikr kiye gaye usul aesehi laagu honge jaese Qaanuun-saaz Majlis ke araakeen par laagu hote hae.
The provisions of clauses (1), (2) and (3) shall apply in relation to persons who by virtue of this Constitution have the right to speak in, and otherwise to take part in the proceedings of, a House of the Legislature of a State or any committee thereof as they apply in relation to members of that Legislature.

195. Araakeen ki ujrat aur tankhwaah.—
Salaries and allowances of members.—

Kisi Riyaasat ki Riyaasati Majlis aur Riyaasati Shura ke araaken ka aesi ujrat aur tankhwaah haasil karne ka haq hoga jaesi ke oos Riyaasat ki Qaanuun-saaz Majlis qaanuun ke zariye waqt ba waqt mutayyin kare aur, jab tak is mutalliq koi usul nahi banaaya jaata, tab tak tankhwaah oos sharaah aur oon haalaat ke mutaabiq hogi jaesi ke is Aain ki nafaazat se fauran qabl mutalliq Suube ki Subaayi Majlis ke araakeen ke ma’amle me laagu hoti thi.
Members of the Legislative Assembly and the Legislative Council of a State shall be entitled to receive such salaries and allowances as may from time to time be determined, by the Legislature of the State by law and, until provision in that respect is so made, salaries and allowances at such rates and upon such conditions as were immediately before the commencement of this Constitution applicable in the case of members of the Legislative Assembly of the corresponding Province.

190. Maqaamaat ka khaali hona.—
Vacation of seats.—

190(1). Koi bhi shakhs kisi bhi Riyaasat ki Qaanuun-saaz Majlis ke donohi Aewaan ka rukn nahi reh sakta aur Riyaasat ki Qaanuun-saaz Majlis ko qaanuun ke zariye ye usul banana hoga taake kisi shakhs ko jo donohi Aewaan ka rukn chuna gaya ho ooska ya tou is Aewaan se ya tou oos Aewaan se maqaam khaali karaaya jaaye.
No person shall be a member of both Houses of the Legislature of a State and provision shall be made by the Legislature of the State by law for the vacation by a person who is chosen a member of both Houses of his seat in one house or the other.

190(2). Koi bhi shakhs aesi Riyaasaat jo Pehli Fehrist me darj hae oonme se ek hi waqt do ya zaaid Riyaasaat ki Qaanuun-saaz Majaalis ka rukn nahi reh sakta, aur agar kisi shakhs ko aesi do ya zaaid Riyaasaat ki Qaanuun-saaz Majaalis ka rukn chuna gaya ho tou, fir, Sadar e Jamhuriya ke zariye banaaye gaye qawaaid me waazae ki gayi muddat poori ho jaane ke baad, oos shakhs ka aesi tamaam Riyaasaat ki Qaanuun-saaz Majaalis me maqaam khaali ho jaaye ga, agar oos shakhs ne iske pehle hi ek ko chhod ke tamaan Riyaasaat ki Qaanuun-saaz Majaalis ke apne maqaam se istefaa naa de diya ho.
No person shall be a member of the Legislatures of two or more States specified in the First Schedule and if a person is chosen a member of the Legislatures of two or more such States, then, at the expiration of such period as may be specified in rules made by the President, that person's seat in the Legislatures of all such States shall become vacant, unless he has previously resigned his seat in the Legislatures of all but one of the States.

190(3). Agar kisi Riyaasat ki Qaanuun-saaz Majlis ke kisi bhi Aewaan ka koi rukn—
If a member of a House of the Legislature of a State—

190(3a). mazmoon 191 ke nukut (1) ya nukut (2) me zikr ki gayi kisi na-aehliyat ke tehet aajaaye to; ya
becomes subject to any of the disqualifications mentioned in clause (1) or clause (2) of article 191; or

190(3b). Amiir ya Mukallim, jaesa bhi ma’amla ho, oonko apni dastakhat shuda tehrir ke zariye apne maqaam se istefe ki ittela bhej de, aur ooska istefa Amiir ya Mukallim, jaesa bhi ma’amla ho, manzuur kar le, tou ooska maqaam fauran khaali ho jaaye ga:
resigns his seat by writing under his hand addressed to the speaker or the Chairman, as the case may be, and his resignation is accepted by the Speaker or the Chairman, as the case may be, his seat shall thereupon become vacant:

Shart ye hae ke zere-nukut (b) me zikr kiye gaye istefe ke ma’amle me, agar ittela mil jaane ke baad ya digar zariye se ma’lumat haasil ho jaane ke baad aur oonhe jaesa munaasib lage waesi taftiish karaane ke baad, Amiir ya Mukallim, jaesa bhi ma’amla ho, agar wo mutmaiin ho jaate hae ke wo istefa khud ki marzi se nahi diya gaya tha ya jaali tha, tou wo aese istefa ko wo manzuur nahi karenge.
Provided that in the case of any resignation referred to in sub-clause (b), if from information received or otherwise and after making such inquiry as he thinks fit, the Speaker or the Chairman, as the case may be, is satisfied that such resignation is not voluntary or genuine, he shall not accept such resignation.

190(4). Agar koi rukn baghaer ijaazat ke kisi Riyaasat ki Qaanuun-saaz Majlis ke kisi bhi Aewaan ki tamaam nashistou se musalsal saath dinou ki muddat tak ghaer-haazir raha hou tou, Aewaan chaahe tou ooska maqaam khaali karaar de sakta hae:
If for a period of sixty days a member of a House of the Legislature of a State is without permission of the House absent from all meetings thereof, the House may declare his seat vacant:

Shart ye hae ke bataayegaye saath dinou ka hisaab lagaane me aesi kisi bhi muddat ko shumaar nahi kiya jaaye ga jab Aewaan ka chaar dino se zaaid ke liye ijlaas multawi ya nashist multawi ki gayi ho.
Provided that in computing the said period of sixty days no account shall be taken of any period during which the House is prorogued or is adjourned for more than four consecutive days.

191. Rukniyat ki na-aehliyat.—
Disqualifications for membership.—

191(1). Oos shakhs ko kisi Riyaasat ki Riyaasati Majlis ya Riyaasati Shura ke rukn chune jaane se, aur rukn hone se na-aehl kar diya jaaye ga—
A person shall be disqualified for being chosen as, and for being, a member of the Legislative Assembly or Legislative Council of a State—

191(1a). agar wo Hukumat e Hind ya kisi Riyaasat ki Hukumat ke tehat ki munaafe ke ohde par faaiz ho, siwaaye oon ohdou ke jinhe Riyaasat ki Qaanuun-saaz Majlis ne qaanuun ke zariye aesa aelaan kiya ho ke ye wo ohde hae jinpar jo faaiz ho ye oonhe na-aehl nahi karte;
if he holds any office of profit under the Government of India or the Government of any State specified in the First Schedule, other than an office declared by the Legislature of the State by law not to disqualify its holder;

191(1b). agar wo zehni taur se bimaar hou aur aesa oonhe is qabil kisi adaalat ne thehraaya ho;
if he is of unsound mind and stands so declared by a competent court;

191(1c). agar wo ek ghaer e bari diwaalia ho;
if he is an undischarged insolvent;

191(1d). agar wo Hind ka shehri nahi hae, ya oosne khud ki marzi se kisi digar Mulk ki shehriyat haasil kar li ho, ya kisi digar Mulk ka taslim shuda wafaadaar ya tarafdaar hae;
if he is not a citizen of India, or has voluntarily acquired the citizenship of a foreign State, or is under any acknowledgment of allegiance or adherence to a foreign State;

191(1e). agar oose Qaumi Majlis ke zariye banaaye gaye kisi bhi qaanuun ke zariye ya ooske tehat na-aehl kar diya gaya ho.
if he is so disqualified by or under any law made by Parliament.

Wazaahat.—Is mazmoon ke maqsad ke tehat kisi bhi shakhs ko sirf is bina par munaafe ke ohde par faaiz nahi maana jaayega ke wo Hukumat e Hind ya kisi aesi Riyaasat jo Pehli Fehrist me darj hae ooski Hukumat ke tehat Markaz me ya oos Riyaasat me Wazir hae.
Explanation.—For the purposes of this clause, a person shall not be deemed to hold an office of profit under the Government of India or the Government of any State specified in the First Schedule by reason only that he is a Minister either for the Union or for such State.

191(2). Agar kisi shakhs ko Daswi Fehrist ke tehat is mutalliq na-aehl maana gaya ho tou oose kisi Riyaasat ki Riyaasati Majlis ya Riyaasati Shura ka rukn hone se bhi na-aehl maana jaayega.
A person shall be disqualified for being a member of the Legislative Assembly or Legislative Council of a State if he is so disqualified under the Tenth Schedule.

192. Araakeen ki na-aehliyaat ke sawaalaat par faesla.—
Decision on questions as to disqualifications of members.—

192(1). Agar koi sawaal uthta hae ke kisi Riyaasat ki Qaanuun-saaz Majlis ke kisi Aewaan ka koi rukn mazmoon 191 ke nukut (1) ke me zikr ki gayi kisi bhi na-aehliyaat ke tehat aata ho tou, faesle ke liye oos sawaal ko Naazim e Riyaasat ki madde nazar kiya jaaye ga aur oonka faesla hatami hoga.
If any question arises as to whether a member of a House of the Legislature of a State has become subject to any of the disqualifications mentioned in clause (1) of article 191, the question shall be referred for the decision of the Governor and his decision shall be final.

192(2). Aese kisi sawaal par koi faesla dene se qabl, Naazim e Riyaasat ko Intekhaabi Wafaz ki raae haasil karni hogi aur oonhe oos raae ke mutaabiq amal karna hoga. Before giving any decision on any such question, the Governor shall obtain the opinion of the Election Commission and shall act according to such opinion.

193. Mazmoon 188 ke tehat halaf lene ya Aehad karne se qabl ya jab aehliyat na ho tou ya na-aehl kiye jaane ke baad baethhne aur raae dene ka jurmana.—
Penalty for sitting and voting before making oath or affirmation under article 188 or when not qualified or when disqualified.—

Koi shakhs mazmoon 188 ki sharaaet poori karne se qabl, ya jab oose ma’aluum ho ke wo is mutalliq na-aehl hae ya oosko rukn hone se na-aehl karaar diya gaya hae, ya ooske aesa karne par Qaumi Majlis ya Riyaasat ki Qaanuun-saaz Majlis ke banaaye gaye kisi qaanuun ke usul ke tehat mamnuhaat hae, agar wo Riyaasati Majlis ya Riyaasati Shura ke rukn ki haesiyat se baeththa ho ya raae di ho tou, har wo din jab wo baeththa ho aur raae di ho har din ke liye paanch sau rupaye jurmaana ada karne ka zimmedaar hae jise Riyaasat ki jaanib se diye gaye karz ke taur par oosse wasula jaayega.
If a person sits or votes as a member of the Legislative Assembly or the Legislative Council of a State before he has complied with the requirements of article 188, or when he knows that he is not qualified or that he is disqualified for membership thereof, or that he is prohibited from so doing by the provisions of any law made by Parliament or the Legislature of the State, he shall be liable in respect of each day on which he so sits or votes to a penalty of five hundred rupees to be recovered as a debt due to the State.
