166. Kisi Riyaasat ki Hukumat ke kaam ka tarze amal.—
Conduct of business of the Government of a State.—

166(1). Ye maana jayega ke kisi Riyaasat ki Hukumat ke taamaam amaliyaati kaarwaahi ki wazaahat Naazim e Riyaasat ke naam par ada ki jaa rahi hae.
All executive action of the Government of a State shall be expressed to be taken in the name of the Governor.

166(2). Naazim e Riyaasat ke naam par banaaye gaye aur amal me laaye gaye Ahkaam-naame aur digar dastaawez ki tauseeq Naazim e Riyaasat ke banaaye gaye qaaede me waazae kiye gaye tariqe ke mutaabiq hogi, aur aese tauseeq shuda hukm naame ya dastaawez ki tasdeeq par is bina par sawaal nahi uthaaya jaa sakta ke wo Naazim e Riyaasat ka banaaya gaya ya unka amal me laaya gaya hukm naama ya dastaawez nahi hae.
Orders and other instruments made and executed in the name of the Governor shall be authenticated in such manner as may be specified in rules to be made by the Governor, and the validity of an order or instrument which is so authenticated shall not be called in question on the ground that it is not an order or instrument made or executed by the Governor.

166(3). Naazim e Riyaasat Riyaasat ki Hukumat ke kaam ki ta’amiil ko mazid aasaan karne ke liye, aur aese kaam ko Wazara ke darmeyaan taqseem karne ke mutalliq qawaaid banaayenge, oos had tak ke kaam aese nahi honge jin kaam ka oonki aql se kiya jaana Naazim e Riyaasat ke liye Aain ke zariye ya is Aain ke tehat laazim ho.
The Governor shall make rules for the more convenient transaction of the business of the Government of the State, and for the allocation among Ministers of the said business in so far as it is not business with respect to which the Governor is by or under this Constitution required to act in his discretion.

167. Naazim e Riyaasat ko ma’alumaat faraaham karne ke mutalliq Wazir e Aala ke faraaez, waghaera.—
Duties of Chief Minister as respects the furnishing of information to Governor, etc.—

Ye har ek Riyaasat ke Wazir e Aala par farz hoga ke wo—
It shall be the duty of the Chief Minister of each State—

167(a). Riyaasat ke ma’amlaat ki nizaamat, aur qaanuun-saazi ki tajwizaat ke mutalliq Wazaarat ke tamaam faeslou ki ittela Naazim e Riyaasat ko de;
to communicate to the Governor of the State all decisions of the Council of Ministers relating to the administration of the affairs of the State and proposals for legislation;

167(b). Riyaasat ke ma’amlaat ki nizaamat, aur qaanuun-saazi ki tajwizaat ke mutalliq Wazaarat ke tamaam faeslou ki ittela, jinka Naazim e Riyaasat mutaalba kare, unki ittela Naazim e Riyaasat ko de; aur
to furnish such information relating to the administration of the affairs of the State and proposals for legislation as the Governor may call for; and

167(c). Agar kisi mas’ale par kisi ek Waziir ne koi faesla kiya ho lekin uspar Wazaarat ne gaur o fikr nahi ki ho, tou agar Naazim e Riyaasat is mutalliq mutaalba kare, tou oos mas’ale ko Wazaarat ke saamne gaur o fikr ke liye bheje.
if the Governor so requires, to submit for the consideration of the Council of Ministers any matter on which a decision has been taken by a Minister but which has not been considered by the Council.

165. Riyaasat ke Riyaasati Wakeel.—
Advocate-General for the State.—

165(1). Har ek Riyaasat ke Naazim e Riyaasat ek aese shakhs ko Riyaasat ke Riyaasati Wakeel mukarrar karenge jo Adaalat e Aalia me Qaazi mukarrar kiye jaane ke aehl ho.
The Governor of each State shall appoint a person who is qualified to be appointed a Judge of a High Court to be Advocate-General for the State.

165(2). Ye Riyaasati Wakeel par farz hoga ke wo Riyaasat ki Hukumat ko aese qaanuuni ma’amlaat me apni raae de, aur aese digar faraaez ki ta’amil kare jo qaanuuni nauiyyat ke hou, jinhe Naazim e Riyaasat ne waqt ba waqt oonke saamne madde nazar kiya ho ya oonhe saupa ho, aur aese a’amaal ki takmeel kare jo is Aain ya kisi digar maujudaah qaanuun ke zariye oonpar aaed kiye gaye hou.
It shall be the duty of the Advocate-General to give advice to the Government of the State upon such legal matters, and to perform such other duties of a legal character, as may from time to time be referred or assigned to him by the Governor, and to discharge the functions conferred on him by or under this Constitution or any other law for the time being in force.

165(3). Riyaasati Wakeel apne ohde par tab tak hi qaayam rahenge jab tak ke Naazim e Riyaasat ki raza ho, aur oonhe aesa muaawaza ada kiya jaayega jaesa ke Naazim e Riyaasat mutayyin kare.
The Advocate-General shall hold office during the pleasure of the Governor, and shall receive such remuneration as the Governor may determine.

163. Wazaarat ka Naazim e Riyaasat ko mashwara dena aur oonki madad karna.—
Council of Ministers to aid and advise Governor.—

163(1). Ek Wazaarat hogi jiske amiir Wazir e Aala honge, ye Wazaarat Naazim e Riyaasat ko oonke a’amaal ki takmiil me mashwara degi aur unki madad karegi, siwaaye tab jab jis had tak is Aain ke zariye ya is Aain ke tehat oonpar ye laazim ho ke wo aese kisi bhi a’amal ki takmiil oonki khud ki aql se karenge.
There shall be a Council of Ministers with the Chief Minister at the head to aid and advise the Governor in the exercise of his functions, except in so far as he is by or under this Constitution required to exercise his functions or any of them in his discretion.

163(2). Agar aesa koi sawaal uthhta hae ke koi ma’amla aesa hae ya nahi jisme is Aain ke zariye ya is Aain ke tehat Naazim e Riyaasat par ye laazim hae ke oos ma’amle ki takmiil wo oonki khud ki aql se kare tou, Naazim e Riyaasat is par oonki aql se jo faesla karenge wo hatami hoga, aur Naazim e Riyaasat ke kiye gaye kisi amal ki sehat par is bina par sawaal nahi uthhaaya ja sakta ke oonhe amal oonki khud ki aql se karna tha ya nahi karna tha.
If any question arises whether any matter is or is not a matter as respects which the Governor is by or under this Constitution required to act in his discretion, the decision of the Governor in his discretion shall be final, and the validity of anything done by the Governor shall not be called in question on the ground that he ought or ought not to have acted in his discretion.

163(3). Is sawaal par kisi bhi adaalat me tahqiiq nahi ki jaa sakti ke Wazara ne Naazim e Riyaasat ko mashwara diya ya nahi, aur agar diya to kya mashwara diya.
The question whether any, and if so what, advice was tendered by Ministers to the Governor shall not be inquired into in any court.

164. Wazara ke mutalliq digar usul.—
Other provisions as to Ministers.—

164(1). Naazim e Riyaasat Waziir e Aala ko mukarrar karenge aur Waziir e Aala ke mashware par Naazim e Riyaasat digar Wazara ko mukarrar karenge, aur Wazara apne ohdou par tab tak hi qaayam rahenge jab tak ke Naazim e Riyaasat ki raza ho:
The Chief Minister shall be appointed by the Governor and the other Ministers shall be appointed by the Governor on the advice of the Chief Minister, and the Ministers shall hold office during the pleasure of the Governor:

Shart ye hae ke Chhattisgadh, Jhaarkhand, Madhya Pradesh aur Odisha Riyaasaat me, ek Waziir qabaaeli falaah ke zimmedaar honge jo maziid Zere Fehrist Zaat aur pasmaanda tabqe ya kisi digar kaam ke zimmedaar bhi ho sakte hae.
Provided that in the States of Chhattisgarh, Jharkhand, Madhya Pradesh and Odisha, there shall be a Minister in charge of tribal welfare who may in addition be in charge of the welfare of the Scheduled Castes and backward classes or any other work.

164(1A). Wazaarat me Waziir e Aala ko shumaar karke tamaam Wazara ki ta’adaad Riyaasati Majlis ke tamaam araakeen ki kul ta’adaad ke pandhra fii-sad se zyaada nahi honi chaahiye:
The total number of Ministers, including the Chief Minister, in the Council of Ministers in a State shall not exceed fifteen per cent. of the total number of members of the Legislative Assembly of that State:

Shart ye hae ke Waziir e Aala ko shumaar karke tamaam Wazara ki ta’adaad kam az kam baara honi chaahiye:
Provided that the number of Ministers, including the Chief Minister in a State shall not be less than twelve:

Mazid shart ye hae ke 2003, Aaini Qaaede (Tarmeen adad Ekyaan-nawwe) ki nafaazat par jaha Waziir e Aala ko shumaar karke tamaam Wazara ki ta’adaad pandhra fii-sad se zaaid ho tou ya pehli shart me waazae kiye gaye adad se zaaid ho tou, jaesa bhi ma’amla ho, tab Wazara ki kul ta’adaad ko oos *taarikh se jise Sadar e Jamhuriya ne awaami ittela ke zariye mukarrar kiya ho tou oos taarikh se chhe maah ki muddat ke dauraan Wazara ki kul ta’adaad ko is nukut ke usul ke mutaabiq laana hoga.
Ittela e zer: Ittela S.O adad 21(E) ba-taarikh 7-1-2004 ke mutaabiq *taarikh hogi 7-1-2004.

Provided further that where the total number of Ministers including the Chief Minister in the Council of Ministers in any State at the commencement of the Constitution (Ninety-first Amendment) Act, 2003 exceeds the said fifteen per cent. or the number specified in the first proviso, as the case may be, then the total number of Ministers in that State shall be brought in conformity with the provisions of this clause within six months from such date* as the President may by public notification appoint.

164(1B). Daswi Fehrist ke hissa e tehriir 2 ke tehat kisi Riyaasat ki Riyaasati Majlis ya aesi Riyaasat ki Qaanuun-saaz Majlis jaha Qaanuun-saaz Shura bhi ho ooske kisi bhi Aewaan ke kisi rukn ko barkhaast kiya jaaye tou oose nukut (1) ke tehat Waziir ke ohde par mukkarrar nahi kiya jaa sakta, wo bhi darje zeel muddat ke liye: jis taarikh ko oose barkhaast kiya gaya ho oos taarikh se lekar in do taarikh me se jo bhi pehle ho oos taarikh tak; ya tou jis taarikh ko ooski rukniyat khatm hogi oos taarikh tak, ya fir rukniyat ki muddat khatm hone ki taarikh se qabl agar wo kisi Riyaasat ki Riyaasati Majlis ya aesi Riyaasat ki Qaanuun-saaz Majlis jaha Qaanuun-saaz Shura bhi ho ooske kisi Aewaan ki rukniyat ke liye intekhaab lade aur oos intekhaab me oose muntakhib aelaan kar diya gaya ho, tou muntakhib hone ki taarikh tak.
A member of the Legislative Assembly of a State or either House of the Legislature of a State having Legislative Council belonging to any political party who is disqualified for being a member of that House under paragraph 2 of the Tenth Schedule shall also be disqualified to be appointed as a Minister under clause (1) for duration of the period commencing from the date of his disqualification till the date on which the term of his office as such member would expire or where he contests any election to the Legislative Assembly of a State or either House of the Legislature of a State having Legislative Council, as the case may be, before the expiry of such period, till the date on which he is declared elected, whichever is earlier.

164(2). Wazaarat ijtemaayi taur par Riyaasati Majlis ke saamne jawaab-daah rahegi.
The Council of Ministers shall be collectively responsible to the Legislative Assembly of the State.

164(3). Kisi Waziir ko ohde par mukarrar karne se qabl Naazim e Riyaasat oose ohde aur raaz-daari ki halaf dilaayenge, halaf oos tehriir ke mutaabiq hogi jise is maqsad ke liye Tiisri Fehrist me darj kiya gaya hae.
Before a Minister enters upon his office, the Governor shall administer to him the oaths of office and of secrecy according to the forms set out for the purpose in the Third Schedule.

164(4). Koi Wazir musalsal chhe maah ki kisi bhi muddat tak Riyaasat ki Qaanuun-saaz Majlis ka rukn nahi raha ho tou oos muddat ke poore hote hi Waziir ke ohde par bhi faez nahi maana jaayega.
A Minister who for any period of six consecutive months is not a member of the Legislature of the State shall at the expiration of that period cease to be a Minister.

164(5). Wazara ki ujrat aur tankhwaah wo hogi jise Riyaasat ki Qaanuun-saaz Majlis ke zariye waqt ba waqt mutayyin karegi, Jab tak Riyaasat ki Qaanuun-saaz Majlis ujrat aur tankhwaah ko mutayyin nahi kar deti tab tak, ujrat aur tankhwaah wohi hogi jo Dusri Fehrist me darj hae.
The salaries and allowances of Ministers shall be such as the Legislature of the State may from time to time by law determine and, until the Legislature of the State so determines, shall be as specified in the Second Schedule.

153. Naazimeen e Riyaasaat.—
Governors of States.—

Har Riyaasat ke ek Naazim e Riyaasat honge:
There shall be a Governor for each State:

Shart ye hae ke is mazmoon ka koi bhi pehlu ek hi shakhs ko do ya zaaid Riyaasaat ka Naazim e Riyaasat mukarrar kiye jaane nahi rokta.
Provided that nothing in this article shall prevent the appointment of the same person as Governor for two or more States.

154. Riyaasat ka amaliyaati ikhteyaar.—
Executive power of State.—

154(1). Riyaasat ka amaliyaati ikhteyaar Naazim e Riyaasat ke supurd hoga aur oon ihkteyaar par amal khud ba-zaat oonke kiya jaayega ya fir oonke naaeb afsaraan ke zariye kiya jaaye ga, aur wo amal is Aain ke mutaabiq hoga.
The executive power of the State shall be vested in the Governor and shall be exercised by him either directly or through officers subordinate to him in accordance with this Constitution.

154(2). Is mazmoon ke kisi bhi pehlu—
Nothing in this article shall—

154(2a). se ye nahi maana jaayega ke kisi bhi digar mohkam ko kisi bhi maujuda qaanuun ke zariye ata kiya gaya kisi a’amaal ko karne ka haq Naazim e Riyaasat ko muntaqil hoga; ya
be deemed to transfer to the Governor any functions conferred by any existing law on any other authority; or

155. Naazim e Riyaasat ka mukarrar kiya jaana.—
Appointment of Governor.—

Naazim e Riyaasat ko Sadar e Jamhuriya oonke dastakhat aur mohr shuda dastawez ke zariye mukarrar karenge.
The Governor of a State shall be appointed by the President by warrant under his hand and seal.

156. Naazim e Riyaasat ke ohde ki muddat.—
Term of office of Governor.—

156(1). Naazim e Riyaasat apne ohde par tab tak hi qaayam rahenge jab tak ke Sadar e Jamhuriya ki raza ho.
The Governor shall hold office during the pleasure of the President.

156(2). Naazim e Riyaasat chaahe tou, wo kisi bhi waqt, apne dastakhat ke tehat Sadar e Jamhuriya ko di gayi apni tehriir ke zariye, apne ohde se istefa de sakte hae.
The Governor may, by writing under his hand addressed to the President, resign his office.

156(3). Is mazmoon ke zere zikr usul ke tehet rehte hue, Naazim e Riyaasat jis taarikh se apne ohde par faaez honge us taarikh se lekar paanch saal ki muddat tak apne ohde par faaez rahenge:
Subject to the foregoing provisions of this article, a Governor shall hold office for a term of five years from the date on which he enters upon his office:

Shart ye hae keNaazim e Riyaasat, ape ohde ki muddat ke khatm ho jaane ke baawajood, apne ohde par faaez rahenge jab tak ke unke jaanasheen ohde par khud faaez nahi ho jaate.
Provided that a Governor shall, notwithstanding the expiration of his term, continue to hold office until his successor enters upon his office.

157. Naazim e Riyaasat mukarrar kiye jaane ki aehliyat.—
Qualifications for appointment as Governor.—

Kisi bhi shakhs Naazim e Riyaasat mukarrar kiye jaane ke liye aehl tab’hi maana jaaye ga jab wo Hind ka shehri hoga aur oosne paetiis saal ki umr mukammil kar li hogi.
No person shall be eligible for appointment as Governor unless he is a citizen of India and has completed the age of thirty-five years.

158. Naazim e Riyaasat ke ohde ki sharaaet.—
Conditions of Governor's office.—

158(1). Naazim e Riyaasat Qaumi Majlis ke done me se kisi bhi Aewaan ke rukn nahi ho sakte, aur kisi bhi aesi Riyaasat jo Pehli Fehrist me darj hae ooski Qaanuun-Saaz Majlis ke kisi bhi Aewaan ke rukn nahi ho sakte, aur agar Qaumi Majlis ke dono me se kisi bhi Aewaan ke kisi rukn ko ya kisi bhi Riyaasat ki Qaanuun-Saaz Majlis ke kisi bhi Aewaan ke kisi rukn ko Naazim e Riyaasat muntakhib kiya jaata hae tou, ye maana jaayega ke onhone oos Aewaan jiske wo rukn the waaha se apni rukniyat ko oos taarikh ko tarq kar diya jis din wo Naazim e Riyaasat ke ohde par faaez honge.
The Governor shall not be a member of either House of Parliament or of a House of the Legislature of any State specified in the First Schedule, and if a member of either House of Parliament or of a House of the Legislature of any such State be appointed Governor, he shall be deemed to have vacated his seat in that House on the date on which he enters upon his office as Governor.

158(2). Naazim e Riyaasat digar kisi bhi munaafe ke ohde par faaez nahi ho sakte.
The Governor shall not hold any other office of profit.

158(3). Naazim e Riyaasat ka ye haq hoga ke wo kiraaye ki adaayagi ke baghaer apni tamaam Sarkaari Rihaayish ka ist’emaal kar sakte hae aur saath hi aese munaafe, tankhwaah aur imtiyaazaat ko haasil kar sakte hae jise Qaumi Majlis ne qanuun ke zariye mutayyin kiya ho, jab tak ke is mutalliq usul tayyar nahi kar diya jaate, tab tak aese munaafou, tankhwaah aur imtiyaazaat wo honge jo Dusri Fehrist me darj hae.
The Governor shall be entitled without payment of rent to the use of his official residences and shall be also entitled to such emoluments, allowances and privileges as may be determined by Parliament by law and, until provision in that behalf is so made, such emoluments, allowances and privileges as are specified in the Second Schedule.

158(3A). Jab ek hi shakhs ko do ya zaaid Riyaasaat ka Naazim e Riyaasat mukarrar kiya jaye tou, Naazim e Riyaasat ko ada karda munaafe aur tankhwaah ko oon Riyaasaat ke darmeyaan aesi nisbat ke saath taqsiim kiya jaayega jaesi ke Sadar e Jamhuriya oonke hukm ke zariye mutayyin karenge.
Where the same person is appointed as Governor of two or more States, the emoluments and allowances payable to the Governor shall be allocated among the States in such proportion as the President may by order determine.

158(4). Naazim e Riyaasat ke ohde ki muddat ke dauraan oonke munaafe aur tankhwaah ko kam nahi kiya jaa sakta.
The emoluments and allowances of the Governor shall not be diminished during his term of office.

159. Naazim e Riyaasat ke Ohde ki Qubuliyat ki halaf.—
Oath or affirmation by the Governor.—

Har Naazim e Riyaasat ko aur har wo shakhs jo Naazim e Riyaasat ke ikhteyaaraat ki takmiil kar rahe ho tou oonhe, wo Riyaasat jis Adaalat e Aalia ke daaeraye ikhteyaar me ho ooske Qaazi e Aala ki maujudgi me, agar wo maujud na ho tou fir oos Adaalat e Aalia ke aehem-tariin Qaazi jo maujud hou to unki maujudgi me, apne ohde par faaez hone se qabl, Halaf lena ya Aehad karna hoga aur dastekhat karna hoga, is tariqe se—
Every Governor and every person discharging the functions of the Governor shall, before entering upon his office, make and subscribe in the presence of the Chief Justice of the High Court exercising jurisdiction in relation to the State, or, in his absence, the senior most Judge of that Court available, an oath or affirmation in the following form, that is to say—

“Mae, A.B., ‘Khuda ki Qasam leta hu/ pukhta aehed leta hu’ ke mae mukammil imaandaari ke saath ......... (Riyaasat ka naam) ke Naazim e Riyaasat ke ohde ko munazzim karunga [ya ......... (Riyaasat ka naam) ke Naazim e Riyaasat ke a’amaal ki takmiil karunga], aur apni mukammil salaahiyaat ke zariye Aain aur Qaanuun ki nigeh-baani, tahhaffuz aur inki difaa karunga aur mai apne aap ko ..…… (Riyaasat ka naam) ki awaam ki khidmat aur bhalaayi ke liye waqf kar dunga.”
“I, A. B., do swear in the name of God/ solemnly affirm that I will faithfully execute the office of Governor (or discharge the functions of the Governor) of .........(name of the State) and will to the best of my ability preserve, protect and defend the Constitution and the law and that I will devote myself to the service and well-being of the people of ..……(name of the State).”

160. Ba’az Naagahaani haalat ke dauraan Naazim e Riyaasat ke a’amaal ki takmiil.—
Discharge of the functions of the Governor in certain contingencies.—

Is baab me tazkira nahi kiye gaye kisi bhi naagahaani haalat ke dauraan kisi Riyaasat ke Naazim e Riyaasat ke a’amaal ki takmiil ke mutalliq Sadar e Jamhuriya aese usul qaayam kar sakte hae jaesa ke wo munaasib samjhe.
The President may make such provision as he thinks fit for the discharge of the functions of the Governor of a State in any contingency not provided for in this Chapter.

161. Naazim e Riyaasat ka me ma’afi, waghaera dene ka ikhteyaar, aur baaz muqaddamaat ke faeslou ko ma’atal karne ka, radd karne ka ya onki saza ko kam karne ka haq.—
Power of Governor to grant pardons, etc., and to suspend, remit or commute sentences in certain cases.—

Naazim e Riyaasat ko darj e zeel ma’amle me saza me ma’afi dene ka, osko ma’atal karne ka, osme mohlat dene ya oosko kam karne ka ikhteyaar hae ya darj e zeel ma’amle ke kisi bhi jurm me mujrim thhehraaye gaye kisi shakhs ke oopar sunaaye gaye faesle ko ma’atal karne ka, osko radd karne ka ya oski saza ko kam karne ka ikhteyaar hae, aesa ma’amla jispar oos Riyaasat ke amaliyaati ikhteyaar laagu hote hae—
The Governor of a State shall have the power to grant pardons, reprieves, respites or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence against any law relating to a matter to which the executive power of the State extends.

162. Riyaasat ke amaliyaati ikhteyaar ki had.—
Extent of executive power of State.—

Is Aain ke usul ke tehat, Riyaasat ke amaliyaati ikhteyaar ki had oon tamaam ma’amlaat me laagu hogi jinme Riyaasat ki Qaanuun-saaz Majlis ko qaanuun-saazi ke ikhteyaar hae:
Subject to the provisions of this Constitution, the executive power of a State shall extend to the matters with respect to which the Legislature of the State has power to make laws:

Provided that in any matter with respect to which the Legislature of a State and Parliament have power to make laws, the executive power of the State shall be subject to, and limited by, the executive power expressly conferred by this Constitution or by any law made by Parliament upon the Union or authorities thereof.

148. Hind ke Qaumi Naazim o Muhaasib.—
Comptroller and Auditor-General of India.—

148(1). Hind ke ek Qaumi Naazim o Muhaasib honge jinhe Sadar e Jamhuriya oonke dastakhat wa mohr shuda dastawez ke zariye mukarrar karenge aur jinhe oonke ohde se oosi tariqe se aur oonhi bina par hataaya ja sakta hae jis tariqe se aur jin pina par Adaalat e Uzma ke kisi Qaazi ko hataaya ja sakta hae.
There shall be a Comptroller and Auditor-General of India who shall be appointed by the President by warrant under his hand and seal and shall only be removed from office in like manner and on the like grounds as a Judge of the Supreme Court.

148(2). Har oon shakhs ko jinhe Hind ka Qaumi Naazim o Muhaasib mukarrar kiya jaayega oonhe apna maqaam haasil karne se qabl, Sadar e Jamhuriya ke, ya kisi aese shakhs ke saamne jise Sadar e Jamhuriya ne is muttaliq mukarrar kiya ho, ek halaf leni hogi ya aehad karna hoga, oos tehriir ke mutaabiq jo is maqsad ke liye Tisri Fehrist me darj hae.
Every person appointed to be the Comptroller and Auditor-General of India shall, before he enters upon his office, make and subscribe before the President, or some person appointed in that behalf by him, an oath or affirmation according to the form set out for the purpose in the Third Schedule.

148(3). Qaumi Naazim o Muhaasib ki khidmat ki ujrat aur digar sharaaet waese hongi jaesi ke Qaumi Majlis ne qaanuun ke zariye mutayyin ki hogi aur, jab tak ise aese mutayyin nahi kiya jaata, ye waesi hongi jaese Dusri Fehrist me waazae hae:
The salary and other conditions of service of the Comptroller and Auditor-General shall be such as may be determined by Parliament by law and, until they are so determined, shall be as specified in the Second Schedule:

Shart ye hae ke Qaumi Naazim o Muhaasib ko mukarrar kar diye jaane ke baad oonki ujrat me aur oonke chhutti ke, wazife ke ya maazuul hone ki umr ke haquq me oonke mutalliq ghaer munaafa-baksh tabdiili nahi ki jaa sakti hae.
Provided that neither the salary of a Comptroller and Auditor-General nor his rights in respect of leave of absence, pension or age of retirement shall be varied to his disadvantage after his appointment.

148(4). Qaumi Naazim o Muhaasib oonke ohde se hat jaane ke baad ye ahliyat nahi rakhenge ke oonhe Hukumat e Hind ya kisi bhi Riyaasat ki Hukumat ke tehet mazid ohde par mukarrar kiya jaa sake.
The Comptroller and Auditor-General shall not be eligible for further office either under the Government of India or under the Government of any State after he has ceased to hold his office.

148(5). Is Aain ke usul aur Qaumi Majlis ke banaaye gaye kisi bhi qaanuun ke tehet rehte hue, oon ashkhaas ki khidmat ki sharaaet jo Hind ke Muhaasibe aur Khaata Mehkame me khidmat faraaham karte hae aur Qaumi Naazim o Muhaasib ke nizaamat ke ikhteyaaraat aese honge jo aese qawaaid me darj honge jinhe Sadar e Jamhuriya ne Qaumi Naazim o Muhaasib ke saath mashwara kiye jaane ke baad qaayam kiya hoga.
Subject to the provisions of this Constitution and of any law made by Parliament, the conditions of service of persons serving in the Indian Audit and Accounts Department and the administrative powers of the Comptroller and Auditor-General shall be such as may be prescribed by rules made by the President after consultation with the Comptroller and Auditor-General.

148(6). Qaumi Naazim o Muhaasib ke daftar ki nizaamat ke ikhraajaat, oos daftar me khidmat faraaham karte tamaam ashkhaas ke mutalliq ya oonko ada karda tamaam ujraat, tankhwaah aur wazaaif ke ikhraajaat ki shumuliyat ke saath, Hind ke Majmui Khazaane se ada kiya jaayega.
The administrative expenses of the office of the Comptroller and Auditor-General, including all salaries, allowances and pensions payable to or in respect of persons serving in that office, shall be charged upon the Consolidated Fund of India.

149. Qaumi Naazim o Muhaasib ke faarez aur ikhteyaaraat.—
Duties and powers of the Comptroller and Auditor-General.—

Qaumi Naazim o Muhaasib Markaz ke aur Riyaasaat ke aur kisi digar mohkam ya mehkame se judhe khaatou ke mutalliq aese faraaez anjaam denge aur aese ikhteyaaraat ki takmiil karenge jaese Qaumi Majlis ke banaaye gaye kise qaanuun ke tehet ya ooske zariye waazae kiye gaye honge aur, jab tak is mutalliq usul nahi banaaye jaate, tab tak aese faraaez anjaam denge aur aese ikhteyaaraat ki takmiil karenge jinhe Hind ke Qaumi Muhaasib is Aain ki nafaazat se fauran qabl tak Mumlikat e Hind aur ooske Subaat ke khaatou ke mutalliq faraaez anjaam diya karte the aur ikhteyaaraat ki takmiil kiya karte the.
The Comptroller and Auditor-General shall perform such duties and exercise such powers in relation to the accounts of the Union and of the States and of any other authority or body as may be prescribed by or under any law made by Parliament and, until provision in that behalf is so made, shall perform such duties and exercise such powers in relation to the accounts of the Union and of the States as were conferred on or exercisable by the Auditor-General of India immediately before the commencement of this Constitution in relation to the accounts of the Dominion of India and of the Provinces respectively.

150. Markaz aur Riyaasaat ke khaatou ki tarteeb.—
Form of accounts of the Union and of the States.—

Markaz aur Riyaasaat ke khaatou ko oos tarteeb se darj kiya jaayega jaese ke jise agar Sadar e Jamhuriya chaahe tou Qaumi Naazim o Muhaasib ke mashware par waazae kar de.
The accounts of the Union and of the States shall be kept in such form as the President may, on the advice of the Comptroller and Auditor-General of India, prescribe.

151. Muhaasibe ke tehriiri nataaij.—
Audit reports.—

151(1). Markaz ke khaatou ke mutalliq Qaumi Naazim o Muhaasib ke tehriiri nataaij Sadar e Jamhuriya ke saamne pesh kiye jaayenge, jinhe wo Qaumi Majlis ke dono Aewaan ke saamne rakhenge.
The reports of the Comptroller and Auditor General of India relating to the accounts of the Union shall be submitted to the President, who shall cause them to be laid before each House of Parliament.

151(2). Kisi Riyaasat ke khaatou ke mutalliq Qaumi Naazim o Muhaasib ke tehriiri nataaij oos Riyaasat ke Naazim e Riyaasat ke saamne pesh kiye jaayenge, jinhe wo Riyaasat ki Qaanuun-saaz Majlis ke saamne rakhenge.
The reports of the Comptroller and Auditor-General of India relating to the accounts of a State shall be submitted to the Governor of the State, who shall cause them to be laid before the Legislature of the State.

In this Part, unless the context otherwise requires, the expression “State” does not include the State of Jammu and Kashmir.

393. Mukhtasar naam.—
Short title.—

Is Aain ko Aain e Hind kaha ja sakta hae.
This Constitution may be called the Constitution of India.

394. Nafaazat.—
Commencement.—

Ye mazmoon aur mazaameen 5, 6, 7, 8, 9, 60, 324, 366, 367, 379, 380, 380, 388, 391, 392 aur 393 fauran hi naafez ho jaayenge, aur is Aain ke baqia usul Janwari, 1950 ke chhabbiswe roz ko naafez honge, jis roz ko is Aain me is Aain ki nafaazat kaha gaya hae.
This article and articles 5, 6, 7, 8, 9, 60, 324, 366, 367, 379, 380, 388, 391, 392 and 393 shall come into force at once, and the remaining provisions of this Constitution shall come into force on the twenty-sixth day of January, 1950, which day is referred to in this Constitution as the commencement of this Constitution.

394A. Hindi zabaan me mustanad asha’at.—
Authoritative text in the Hindi language.—

394A(1). Sadar e Jamhuriya apne ikhteyaar ke tehet ye shaae karwaaenge,—
The President shall cause to be published under his authority,—

394A(1a). Is Aain ka Hindi zabaan me tarjuma, jispar Aain-Saaz Majlis ke araakeen ke dastakhat honge, jo aesi tabdiliou ke saath hoga jinhe Markazi Qawaaed ke mustanad Hindi asha’at me apnaaya gaya hae taake zabaan, tarz aur istelaahaat ko hum mayaar kiya jaa sake, aur aese asha’at se qabl is Aain me ki gayi tamaam taraameen ko oosme shumaar karwaaya jaayega; aur
the translation of this Constitution in the Hindi language, signed by the members of the Constituent Assembly, with such modifications as may be necessary to bring it in conformity with the language, style and terminology adopted in the authoritative texts of Central Acts in the Hindi language, and incorporating therein all the amendments of this Constitution made before such publication; and

394A(1b). Angrezi zabaan me ki gayi is Aain ki har ek tarmeen ka Hindi zabaan me tarjuma.
the translation in the Hindi language of every amendment of this Constitution made in the English language.

394A(2). Nukut (1) ke tehet shaae kiye gaye is Aain ke har ek tarjume ke maaene wohi samjhe jaayenge jo maaene ooski asal ke samjhe jaate hae aur agar aese tarjume ke kisi hisse ke maaene ko oos tariqe se samajhne me koi dushwaari pesh aati hae tou, Sadar e Jamhuriya oosko dobaara mowaafiq durust karwaaenege.
The translation of this Constitution and of every amendment thereof published under clause (1) shall be construed to have the same meaning as the original thereof and if any difficulty arises in so construing any part of such translation, the President shall cause the same to be revised suitably.

394A(3). Is mazmoon ke tehet is Aain aur iski har ek tarmeen ke shaae kiye gaye tarjumou ko, har maqsad ke tehet, Hindi zabaan me mustanad asha’at maana jaayega.
The translation of this Constitution and of every amendment thereof published under this article shall be deemed to be, for all purposes, the authoritative text thereof in the Hindi language.

395. Mansuukhaat.—
Repeals.—

1947, Hind ki Khud-Mukhtaari Qaaede ko, aur 1935, Hukumat e Hind Qaaede ko ooski tamaam nafaazat ki gayi tarmeem ya izaafe ke saath, mansuukh kiya jaata hae, lekin 1949, Niji Shura ka Daaeraye-kaar Qaaede ki tardeed ko is ma’amle se alaahida rakha gaya hae.
The Indian Independence Act, 1947, and the Government of India Act, 1935, together with all enactments amending or supplementing the latter Act, but not including the Abolition of Privy Council Jurisdiction Act, 1949, are hereby repealed.
