168. Riyaasaat me Riyaasaati Qaanuun-saaz Majaalis ke qayaam.—
Constitution of Legislatures in States.—

168(1). Har ek Riyaasat ke liye ek ek Riyaasati Qaanuun-saaz Majlis hogi jo Naazim e Riyaasat aur darje zeel par mushtamil hogi—
For every State there shall be a Legislature which shall consist of the Governor, and—

168(1a). Aandhra Pradesh, Bihaar, 1[Madhya Pradesh], Maharaashtra, Karnaataka, 2[Tamil Naadu] aur Uttar Pradesh in Riyaasaat me do Aewaan par;
in the States of Andhra Pradesh, Bihar, 1[Madhya Pradesh], Maharashtra, Karnataka, 2[Tamil Nadu] and Uttar Pradesh, two Houses;

168(2). Jin Riyaasat me Riyaasaati Qaanuun-saaz Majlis ke do Aewaan hae, waha ek Aewaan Riyaasati Shura aur dusra Riyaasati Majlis ke naam se jaane jaayenge, aur jin Riyaasat me mehez ek Aewaan hae, wo Riyaasati Majlis ke naam se jaana jaayega.
Where there are two Houses of the Legislature of a State, one shall be known as the Legislative Council and the other as the Legislative Assembly, and where there is only one House, it shall be known as the Legislative Assembly.

169. Riyaasaat me Riyaasaati Shura ka qayaam kiya jaana ya oonhe khatm kiya jaana.—
Abolition or creation of Legislative Councils in States.—

169(1). Mazmoon 168 ke kisi bhi pehlu ke baawajood, Qaumi Majlis qaanuun ke zariye jis Riyaasat me Riyaasati Shura ho oose khatm karne ka intezaam kar sakti hae ya jis Riyaasat me Riyaasati Shura na ho waha oose qaayam karne ka intezaam kar sakti hae, agar oos Riyaasat ki Riyaasati Majlis ooski rukniyat ki kul ta’adaad ki aksariyat ke saath is mutalliq ek qaraardaad manzuur kare aur Riyaasati Majlis ooske haazir aur raae dene ko tayyaar araakeen ki kam az kam do-tihaayi aksariyat ke saath oose manzuur kare de tou.
Notwithstanding anything in article 168, Parliament may by law provide for the abolition of the Legislative Council of a State having such a Council or for the creation of such a Council in a State having no such Council, if the Legislative Assembly of the State passes a resolution to that effect by a majority of the total membership of the Assembly and by a majority of not less than two-thirds of the members of the Assembly present and voting.

169(2). Koi bhi qaanun jiska zikr nukut (1) me kiya gaya hae usme aese usul shaamil honge jo is Aain ki tarmiin ke mutalliq honge taake zarurat ke mutaabiq qaanuun ke usul ko laagu kara sake aur aese usul bhi shaamil ho sakte hae jo zaaid, fauri aur nataaiji usul par mubani ho jaesa bhi Qaumi Majlis ko munaasib lage.
Any law referred to in clause (1) shall contain such provisions for the amendment of this Constitution as may be necessary to give effect to the provisions of the law and may also contain such supplemental, incidental and consequential provisions as Parliament may deem necessary.

169(3). Koi bhi qaanuun jiska iske pehle zikr kiya gaya hae oose mazmoon 368 ki garaz se tarmiim e Aain nahi maana jaa sakta.
No such law as aforesaid shall be deemed to be an amendment of this Constitution for the purposes of article 368.

170. Riyaasaati Majaalis ki banaawat.—
Composition of the Legislative Assemblies.—

170(1). Mazmoon 333 ke usul ke mutaabiq, Riyaasati Majlis ke araakeen ki ta’adaad me paanch sau se zaaid araakeen aur saathh se kam araakeen shaamil nahi honge, araakeen wo honge jinhe Riyaasat ke intekhaabi halqou se bila-waasta intekhaab ke zariye chuna gaya ho.
Subject to the provisions of article 333, the Legislative Assembly of each State shall consist of not more than five hundred, and not less than sixty, members chosen by direct election from territorial constituencies in the State.

170(2). Nukut (1) ke maqaasaid ke tehat, har ek Riyasat ko is tariqe se intekhaabi halqou me taqsiim kiya jaaye ga ke har ek intekhaabi halqe ki aabaadi aur oos halqe ke ata karda maqaamaat ke adad ka jo tanaassub hoga, wo tanaassub tamaam Riyaasat me, amali aetebaar se, yaksa hoga.
For the purposes of clause (1), each State shall be divided into territorial constituencies in such manner that the ratio between the population of each constituency and the number of seats allotted to it shall, so far as practicable, be the same throughout the State.

Wazaahat.— Is nukut ke tehat, “aabaadi” se muraad oos darj shuda abaadi ke honge jo pichhli aakhri mardam shumaari ke dauraan haasil kiye gaaye the jiske munaasib aakde shaae kar diye gaye hae:
Explanation.—In this clause, the expression “population” means the population as ascertained at the last preceding census of which the relevant figures have been published:

Shart ye hae ke is Wazaahat ke hawaale me jab tak ke saal 2026 ke baad jo pehli mardam shumaari hogi uske munaasib aakde shaaye nahi kar diye jaate , tab tak pichhli aakhri mardam shumaari jiske mutalliq munaasib aakde shaae kiye jaa chuke hou se muraad 2001 ki mardam shumaari maani jaayegi.
Provided that the reference in this Explanation to the last preceding census of which the relevant figures have been published shall, until the relevant figures for the first census taken after the year 2026 have been published, be construed as a reference to the 2001 census.

170(3). Har mardam shumaari ke mukammal ho jaane ke baad, har ek Riyaasat ki Riyaasati Majlis ke maqaamaat ka ta’ayyun aur har ek Riyaasat ke intekhaabi halquo ki taqseem, in dono ki kisi tarteeb e nau kisi aese mehkame aur aese tariiqe se karaayi jaayegi jinhe Qaumi Majlis qaanuun ke zariye ta’e karegi:
Upon the completion of each census, the total number of seats in the Legislative Assembly of each State and the division of each State into territorial constituencies shall be readjusted by such authority and in such manner as Parliament may by law determine:

Shart ye hae ke Riyaasati Majlis me numaaindagi par aesi tarteeb e nau tab tak koi asar nahi daalegi jab tak ke maujuda Majlis ka ikhtetaam nahi ho jaata:
Provided that such readjustment shall not affect representation in the Legislative Assembly until the dissolution of the then existing Assembly:

Mazid Shart ye hae ke aesi tarteeb e nau oos taarikh se laagu hogi, jise Sadar e Jamhuriya ne oonke hukm ke zariye waazae kiya hua ho aur jab tak aesi tarteebe nau laagu nahi ho jaati, Riyaasati Majlis ke mutalliq kisi intekhaab ko aesi tarteeb e nau se qabl jo intekhaabi halqe maujuud the oonke mutalliq karaaye jaa sakte hae:
Provided further that such readjustment shall take effect from such date as the President may, by order, specify and until such readjustment takes effect, any election to the Legislative Assembly may be held on the basis of the territorial constituencies existing before such readjustment:

Shart ye bhi hae ke jab tak saal 2026 ke baad jo pehli mardam shumaari ki jaayegi aur jab tak ooske munaasib aakde shaae nahi kar diye jaate, tab tak darje zeel tarteeb ki tarteeb e nau ki zarurat nahi hogi—
Provided also that until the relevant figures for the first census taken after the year 2026 have been published, it shall not be necessary to readjust—

170(3-i). 1971 ki mardam shumaari ki bina par har ek Riyaasat ki Riyaasati Majlis me maqaamaat ke ta’ayyun ki jo tarteeb ki gayi thi; aur
the total number of seats in the Legislative Assembly of each State as readjusted on the basis of the 1971 census; and

170(3-ii). is nukut ke tehat, 2001 ki mardam shumaari ki bina par har ek Riyaasat ki intekhaabi halqou me jo taqsiim ki jaayegi.
the division of such State into territorial constituencies as may be readjusted on the basis of the 2001 census, under this clause.

171. Riyaasaati Shura ki banaawat.—
Composition of the Legislative Councils.—

171(1). Kisi Riyaasat me jaha Riyaasati Shura ho waha Riyaasati Shura ke araakeen ki kul ta’adaad waha ki Riyaasati Majlis ke araakeen ki kul ta’adaad ki ek-tihaayi se zaaid nahi ho sakti:
The total number of members in the Legislative Council of a State having such a Council shall not exceed one third of the total number of members in the Legislative Assembly of that State:

Shart ye hae ke Riyaasati Shura ke araakeen ki kul ta’adaad kisi bhi surat e haal me chaalis se kam nahi ho sakti.
Provided that the total number of members in the Legislative Council of a State shall in no case be less than forty.

171(2). Jab tak ke Qaumi Majlis qaanuun ke zariye isse hat kar koi digar usul qaayam nahi karti tab tak, kisi Riyaasat ke Riyaasati Shura ki banaawat ke usul nukut (3) me waazae honge.
Until Parliament by law otherwise provides, the composition of the Legislative Council of a State shall be as provided in clause (3).

171(3). Kisi Riyaasat ke Riyaasati Shura ke araakeen ki kul ta’adaad me se—
Of the total number of members of the Legislative Council of a State—

171(3a). ek-tihaayi, ke jitna nazdiik ho sake, ootnou ko wo intekhaabi ijma muntakhib karega jisme Riyaasat ki baldiyaat, ooske zila mehkame aur aese digar ilaaqaayi mehkame jaese ke Qaumi Majlis ne qaanuun ke zariye waazae kiye honge in ke araakeen shaamil honge;
as nearly as may be, one-third shall be elected by electorates consisting of members of municipalities, district boards and such other local authorities in the State as Parliament may by law specify;

171(3b). ek-baarwe, ke jitna nazdiik ho sake, ootnou ko wo intekhaabi ijma muntakhib karega jisme aese afraad shaamil honge jo Riyaasat ke rihaayishi hou aur kam az kam tiin saalou se sarzamiin e Hind ki kisi bhi Jaamia se faazil hou, ya kam az kam tiin saalou se aesi ta’alim rakhte hou jise Qaumi Majlis ke banaaye gaye kisi qaanuun ke zariye ya ooske tehat aesi kisi Jaamia ke faazil hone ke baraabar mutayyin kiya gaya ho;
as nearly as may be, one-twelfth shall be elected by electorates consisting of persons residing in the State who have been for at least three years graduates of any university in the territory of India or have been for at least three years in possession of qualifications prescribed by or under any law made by Parliament as equivalent to that of a graduate of any such university;

171(3c). ek-baarwe, ke jitna nazdiik ho sake, ootnou ko wo intekhaabi ijma muntakhib karega jisme aese afraad shaamil honge jo kam az kam tiin saalou se Riyaasat ke ta’alimi idaarou me, jo dusre mayaar ke madrase ke (iskooli) darjaat se kam na hou, oonme padh’ha rahe hou, jaesa ke mumkina taur par Qaumi Majlis ke banaaye gaye kisi qaanuun ke zariye ya ooske tehat mutayyin kiya gaya ho;
as nearly as may be, one-twelfth shall be elected by electorates consisting of persons who have been for at least three years engaged in teaching in such educational institutions within the State, not lower in standard than that of a secondary school, as may be prescribed by or under any law made by Parliament;

171(3d). ek-tihaayi, ke jitna nazdiik ho sake, ootnou ko Riyaasati Majlis ke araakeen muntakhib karenge, jinho muntakhib kiya jaayega wo Riyaasati Majlis ke araakeen nahi ho sakte;
as nearly as may be, one-third shall be elected by the members of the Legislative Assembly of the State from amongst persons who are not members of the Assembly;

171(3e). Baqia ko Naazim e Riyaasat nukut (5) ke usul ke mutaabiq mukarrar karenge.
the remainder shall be nominated by the Governor in accordance with the provisions of clause (5).

171(4). Zere-Nukut (a), (b) aur (c) ke tehet jin araakeen ko chuna jaana hoga oonhe aese intekhaabi halqaou se chuna jaayega jinhe mumkina taur par Qaumi Majlis ke banaaye gaye kisi qaanuun ke zariye ya ooske tehet mutayyin kiya gaya hoga, aur zikr kiye nukut ke zikr kiye gaye tamaam zere-nukut ke tehet aur zere-nukut (d) ke tehet intekhaab tanaassubi numaaindagi ke nizaam ke mutaabiq waahid muntaqli raae ke zariye karaaye jaayenge.
The members to be elected under sub-clauses (a), (b) and (c) of clause (3) shall be chosen in such territorial constituencies as may be prescribed by or under any law made by Parliament, and the elections under the said sub-clauses and under sub-clause (d) of the said clause shall be held in accordance with the system of proportional representation by means of the single transferable vote.

171(5). Nukut (3) ke zere-nukut (e) ke tehat, Naazim e Riyaasat ke zariye jin araakeen ko muqarrar kiya jaana hae wo aese ashkhaas honge jo in sho’baat maslan:— Adab, science, fan, ta’auni tehriik aur ma’ashri khidmat me makhsus ilm ya amali tajurba rakhte hae.
The members to be nominated by the Governor under sub-clause (e) of clause (3) shall consist of persons having special knowledge or practical experience in respect of such matters as the following, namely:— Literature, science, art, co-operative movement and social service.

172. Riyaasat ki Qaanuun-saaz Majlis ki muddat.—
Duration of State Legislatures.—

172(1). Har ek Riyaasat ki Riyaasati Majlis ka, agar muddat poori hone ke pehle hi ikhtetaam nahi kar diya gaya ho tou, ooski pehli nashist ki taarikh se lekar agle paanch saal ki muddat tak barkaraar rahegi lekin oosse zyaada nahi, aur paanch saal ki muddat poori hone ka matlab hoga maujuda Riyaasati Majlis ka ikhtetaam:
Every Legislative Assembly of every State, unless sooner dissolved, shall continue for five years from the date appointed for its first meeting and no longer and the expiration of the said period of five years shall operate as a dissolution of the Assembly:

Shart ye hae ke, agar Naagahaani Haalaat ka Aelaan naafiz hae tou, Qaumi Majlis ke zariye ek waqt me Aewaan e Awaam ki ek saal muddat badhaayi jaa sakti hae, par kisi bhi ma’amle me Naagahaani Haalaat ka Aelaan ki nafaazat ke hata liye jaane ke baad, Aewaan e Awaam ki muddat chhe maah se zyaada nahi reh sakti.
Provided that the said period may, while a Proclamation of Emergency is in operation, be extended by Parliament by law for a period not exceeding one year at a time and not extending in any case beyond a period of six months after the Proclamation has ceased to operate.

172(2). Kisi bhi Riyaasat ke Riyaasati Shura ka ikhtetaam nahi ho sakta, lekin, is mutalliq Qaumi Majlis ke banaaye gaye qaanuun ke usul ke mutaabiq, jis had tak mumkim ho sake iske ek-tihaayi araakeen ko oonke do saal ki muddat mukammil ho jaane par maazul kar diya jaaye.
The Legislative Council of a State shall not be subject to dissolution, but as nearly as possible one-third of the members thereof shall retire as soon as may be on the expiration of every second year in accordance with the provisions made in that behalf by Parliament by law.

173. Riyaasat ki Qaanuun-saaz Majlis ki rukniyat ki aehliyat.—
Qualification for membership of the State Legislature.—

Koi shakhs kisi Riyaasat ki Qaanuun-saaz Majlis ke kisi maqaam ko bharne ke liye aehl tab hi ho sakta jab wo—
A person shall not be qualified to be chosen to fill a seat in the Legislature of a State unless he—

173(a). Hind ka shehri hou, aur jab oosne Intekhaabi Wafaz ki bina par ikhteyaar diye gaye kisi shakhs ke saamne halaf li ho ya aehad kiya ho, oos tehriir ke mutaabiq jo is maqsad ke liye Tisri Fehrist me darj hae;
is a citizen of India, and makes and subscribes before some person authorised in that behalf by the Election Commission an oath or affirmation according to the form set out for the purpose in the Third Schedule;

173(b). Riyaasati Majlis me maqaam ke ma’amle pachchiis saal ki umar se kam na hou, aur Riyaasati Shura me maqaam ke ma’amle me paitiis saal ki umar se kam na hou; aur
is, in the case of a seat in the Legislative Assembly, not less than twenty-five years of age and, in the case of a seat in the Legislative Council, not less than thirty years of age; and

173(c). aesi digar aehliyaat rakhta hou jaesa ke is mutalliq Qaumi Majlis ne waazae kiya ho ya Qaumi Majlis ke banaaye gaye kisi qaanuun me wazaae hou.
possesses such other qualifications as may be prescribed in that behalf by or under any law made by Parliament.

174. Riyaasat ki Qaanuun-saaz Majlis ke ijlaas, oonka multawi kiya jaana aur oonka ikhtetaam kiya jaana.—
Sessions of the State Legislature, prorogation and dissolution.—

174(1). Naazim e Riyaasat waqt ba waqt, jaesa oonhe munaasib lage waese waqt aur maqaam par, Riyaasati Majlis ko ya Riyaasat ki Qaanuun-saaz Majlis ke dono Aewaan ko nashist ke liye talab kar sakte hae, lekin pichle ijlaas ki akhri nashist aur agle ijlaas ki pehli nashist ki mukarrar ki gayi taarikh ke darmeyaan chhe maah se zyaada ka waqfa nahi hona chahiye.
The Governor shall from time to time summon the House or each House of the Legislature of the State to meet at such time and place as he thinks fit, but six months shall not intervene between its last sitting in one session and the date appointed for its first sitting in the next session.

174(2). Naazim e Riyaasat waqt ba waqt—
The Governor may from time to time—

174(2a). Dono Aewaan ya ek Aewaan ke ijlaas ko Multawi kar sakte hae;
prorogue the House or either House;

174(2b). Riyaasati Majlis ka ikhtetaam kar sakte hae.
dissolve the Legislative Assembly.

175. Naazim e Riyaasat ek ya ka dono Aewaan ko khitaab karne ka aur oonke paighaamaat bhejne ka haq.—
Right of Governor to address and send messages to the House or Houses.—

175(1). Naazim e Riyaasat Riyaasati Majlis ko, aur aese ma’amle me jab Riyaasat me Riyaasati Shura bhi ho tou, oos Riyaasat ki Qaanuun-saaz Majlis ke kisi bhi Aewaan ya ek-saath Majmua Aewaan ko khitaab kar sakte hae, aur oos maqsad ke tehat araakeen ki haaziri zaruri hogi.
The Governor may address the Legislative Assembly or, in the case of a State having a Legislative Council, either House of the Legislature of the State, or both Houses assembled together, and may for that purpose require the attendance of members.

175(2). Naazim e Riyaasat Riyaasat ki Qaanuun-saaz Majlis ke ek ya dono Aewaan ko paighaamaat bhej sakte hae, chaahe koi tajwiiz ke mutalliq paighaam ho jo Riyaasat ki Qaanuun-saaz Majlis me muntazir rakhi hui hou ya koi digar ma’amle ke mutalliq paighaam ho, aur jis Aewaan me aesa koi paighaam bheja gaya hae, tou jis ma’amle ke mutalliq wo paighaam ho, wo Aewaan oospar munaasib jaldi ke tehat ghaur o fikr karega.
The Governor may send messages to the House or Houses of the Legislature of the State, whether with respect to a Bill then pending in the Legislature or otherwise, and a House to which any message is so sent shall with all convenient despatch consider any matter required by the message to be taken into consideration.

176. Naazim e Riyaasat ka makhsuus khitaab.—
Special address by the Governor.—

176(1). Har aam intekhaab ke baad Riyaasati Majlis ke pehle Ijlaas ki shuruwaat me Naazim e Riyaasat Riyaasati Majlis se khitaab karenge aur har saal ke pehle ijlaas ki shuruwaat me Naazim e Riyaasat Riyaasati Majlis aur jis Riyaasat me Riyaasati Shura bhi ho tou oos ke ek-saath Majmua Aewaan se khitaab karenge aur Riyaasat ki Qaanun-saaz Majlis ko oske talab kiye jaane ki wajuhaat ki ittela denge.
At the commencement of the first session after each general election to the Legislative Assembly and at the commencement of the first session of each year, the Governor shall address the Legislative Assembly or, in the case of a State having a Legislative Council, both Houses assembled together and inform the Legislature of the causes of its summons.

176(2). Aewaan ya dono hi Aewaan ke tariqe ki nizaamat karte qaaide ke zariye usul banaaye jaane honge taake jin ma’amlaat ka zikr aese khitaab me uthaaya gaya ho, oonpar Aewaan ya kisi bhi Aewaan me behas karaaye jaane ke liye waqt ke ta’ayyunho sake.
Provision shall be made by the rules regulating the procedure of the House or either House for the allotment of time for discussion of the matters referred to in such address.

177. Dono Aewaan ke mutalliq Wazara aur Riyaasati Wakil ke haquq.—
Rights of Ministers and Advocate-General as respects the Houses.—

Har ek Wazir ko aur Riyaasat ke Riyaasati Wakil ko kisi bhi Riyaasati Majlis me ya, jis Riyaasat me Riyaasati Shura bhi hou tou, donohi Aewaan me, Majmua Aewaan ki kisi bhi nashist me, aur Riyaasat ki Qaanuun-saaz Majlis ke kisi Wafaz me jisme onhe ek rukn ki haesiyat se naam-zad kiya gaya ho, inme bolne ka haq hoga, aur iske alawaa inki kaarwaahi me hissa lene ka haq hoga, lekin is mazmoon ki bina par raae dene ka haq nahi hoga.
Every Minister and the Advocate-General for a State shall have the right to speak in, and otherwise to take part in the proceedings of, the Legislative Assembly of the State or, in the case of a State having a Legislative Council, both Houses, and to speak in, and otherwise to take part in the proceedings of, any committee of the Legislature of which he may be named a member, but shall not, by virtue of this article, be entitled to vote.
